Fuel: restructuring plant for private use

A fuel distribution plant for private use is understood to be a unitary complex, installed within plants at the company's premises or in quarries and/or construction sites, warehouses and the like, consisting of one or more underground or above-ground tanks to be used exclusively for the supply of automotive fuel required for the operation of the individual company's vehicles and motor vehicles.

The renovation of this type of facility is subject to communication or authorisation by the Province. The nautra and contents of the communication vary depending on the category of the restructuring and the theoretical capacity of the tanks.

In the case of changing the product contained in the tanks without changing the tanks themselves, it is necessary to submit a communication for partial restructuring of the plant.

In the case of an increase in capacity due to the installation of new tanks, replacement of existing tanks or relocation of the location
1) if the plant has been started through the simplified procedure (Segnalazione certificata di inizio attività per impianti ad uso privato di capacità fino a 10 mc) after the installation/movement of the tanks and before the first filling it is necessary to send the "Segnalazione certificata di inizio attività per ristrutturazione totale di impianti di distribuzione di carburante ad uso privato";

2) if the installation has been started by means of authorisation (Authorisation for installations with a capacity exceeding 10 mc) before applying to the municipality for a building permit it is necessary to send the "Application for authorisation for total refurbishment of fuel distribution installations for private use".

An administrative sanction of between 1,000 and 6,000 euro shall be imposed on any person who installs and operates a motor fuel distribution activity for private use or totally restructures it in the absence of the prescribed authorisation or the notification of commencement of activity in the case of installations of up to 10 cubic metres.

Any company and local public administration that needs to modify its fuel distribution system for private use.

The interested party shall submit the requested documentation by one of the following means

• by sending it by email to the PEC address indicated on the form;
• by delivering it directly to the competent provincial structure, or to any other peripheral office of the Province
• by sending it by registered mail with advice of receipt;
• by sending it by fax to 0461/494747.

Please note that, if sent electronically, the forms must always be transmitted in a static PDF format that cannot be modified.

Please note that renovation involving the replacement of an above-ground tank with a new above-ground tank always entails the obligation to decommission the existing installation and submit the SCIA for the new installation.

For installations authorised before 2010, please contact the offices in order to identify the correct procedure.

The following documents must be attached to the SCIA for the total renovation of a plant for private use:

1. map extract signed by a qualified technician
2. project of the plant complete with plans, plans, sections, elevations, to an appropriate scale, signed by an authorised technician
3. photographic documentation relating to the state of the places subject to intervention;
4. technical-illustrative report containing a detailed description of the works to be carried out, signed by a qualified technician and containing at least the following information (land registry identification, ownership and urban destination of the area, type and capacity of the tank, type of dispenser, reasons for the intervention)
5. tank calibration table showing the actual capacity of each tank;
6. (only for systems equipped with a tank with a nominal capacity of more than one cubic metre) certification by a qualified technician attesting to the regularity of the system, according to the model approved by the Provincial Council
7. (only if the owner of the area is not the same as the owner of the plant) a copy of the deed certifying the availability of the area on which the plant is located
8. signed copy of the information notice pursuant to Articles 13 and 14 of EU Regulation no. 679 of 2016 (privacy)
9. copy of valid identity document (if the documentation is not digitally signed).

For theauthorisation of total refurbishment of a plant for private use, the following documentation must be attached

1. map extract relating to the area on which the plant will be built, signed by a qualified technician;
2. plan of the plant complete with plans, plans, sections, elevations, to an appropriate scale, signed by a qualified technician;
3. photographic documentation relating to the state of the sites subject to the intervention;
4. technical-illustrative report containing a detailed description of the works to be carried out, signed by a qualified technician and containing at least the following information (land registry identification, ownership and urban destination of the area, type and capacity of the tank, type of dispenser, reasons for the intervention)
5. calibration table of the tanks that will be installed;
6. privacy policy in accordance with EU Regulation no. 679/2016 (privacy);
7. copy of valid identity document (if the documentation is not digitally signed).

For the communication of partial renovation of plant for private use, the following documentation must be attached

1. signed copy of the information notice ex art. 13 and 14 EU Regulation no. 679 of 2016 (privacy)
2. copy of valid identity document (if the documentation is not digitally signed).

Time limits and deadlines.

The competent office, within the deadline indicated, will authorise/not authorise the installation and notify the applicant by PEC. Please note that the authorisation must be attached to the request for the "building permit" required to carry out the tank installation works (the request must be submitted to the municipality).

Failure on the part of the structure to comply with the procedural deadline allows the interested party to apply to the General Manager of the Department of Crafts, Commerce, Promotion, Sport and Tourism to urge the conclusion of the procedure.

Please note that in the case of authorisations, in order for the authorisation to be effective, it is necessary that within 30 days of the completion of the plant's refurbishment work, the technician's certification attesting to the plant's compliance with the authorisation be forwarded to the competent office (see the service sheet "Fuel: technician's certification for plant start-up").

In the case of a SCIA for refurbishment, the activity may be commenced the day after the report is sent. Within 60 days from the submission of the SCIA the competent office verifies the requirements and prerequisites. If the outcome of the verification is negative, it notifies the interested party by means of a PEC communication and imposes the reinstatement of the previous situation. If the activity continues, the company may be sanctioned.

Please note that it is necessary to apply for a tax licence from the Customs and Monopolies Agency for facilities larger than 5 mc.
