Requirements for the installation and operation of a new petrol station for private use

Description

A fuel distribution installation for private use is understood to be a unitary complex, installed at the company's premises or in quarries and/or construction sites, consisting of one or more underground or above-ground tanks to be used exclusively for the supply of automotive fuel required for the operation of the individual company's vehicles and motor vehicles.

The start-up of this type of fuel distribution plant is subject to different requirements depending on the total theoretical capacity of the tanks used.

For capacities of up to 10 theoretical total cubic metres (mc), start-up is subject to the simplified procedure consisting of the submission to the competent office of a Certified Declaration of Start-up Activity (hereinafter SCIA for brevity). For a theoretical capacity exceeding 10 cubic metres, on the other hand,prior authorisation must be obtained from the Province.

Restrictions

In the case of plants larger than 10 cubic metres, before submitting the application, a favourable opinion must be obtained from the Fire Prevention Office (for information contact tel. 0461.492202)

Please note that the SCIA must be submitted once the plant has already been installed and is ready for operation, before the first filling with fuel, and can only be used once the professional's certification has been sent. The authorisation, on the other hand, must be applied for before the plant is built (it is an essential act for applying for a building permit).

The applicant must always be in possession of at least one vehicle in exclusive use of the company/public administration.

The applicant company, if newly established, must already be registered in the trade register and have started business.

An administrative sanction of between €1,000 and €6,000 shall be imposed on any person who installs and operates a motor fuel distribution activity for private use or totally restructures it in the absence of the prescribed authorisation or the notification of commencement of activity in the case of installations of up to 10 cubic metres.

Please refer to the regulations for all other cases in which penalties are provided for.

Who it's for

All companies and local public administrations that need to install a petrol station for private use on the provincial territory

What to do

The interested party submits the SCIA (for installations up to 10 cubic metres) or the application for authorisation (for larger installations) by one of the following means

  1. by sending it by email to the PEC address indicated on the form;
  2. by delivering it directly to the competent provincial structure, or to any other peripheral office of the Province
  3. by sending it by registered mail with advice of receipt;
  4. by sending it by fax to 0461/494747.

Please note that, if sent electronically, the forms must always be transmitted in a static PDF format that cannot be modified.

Special cases

Since an installation for private use is intended for the exclusive refuelling of vehicles or motor vehicles of authorised companies or public administrations, it is only possible to derogate from the principle of exclusive refuelling in the cases provided for by the regulation.

Lastly, it should be noted that public administrations that own fuel distribution facilities for private use may, by way of exception, cede limited quantities of fuel to third parties, subject to notification of the competent provincial structure, in order to meet documented and special requests that could not otherwise be met.

What you need

Documents to be submitted

The documentation to be submitted varies depending on the size of the plant.

For plants of up to 10 mc theoretical size, the SCIA must be submitted, with the following attached

  1. map extract on which the plant has been built, signed by an authorised technician;
  2. planimetry and section of the plant, scale 1:100, in original signed by an authorised technician;
  3. technical report describing the intervention signed by a qualified technician containing at least the following information (land registry identification, ownership and urban destination of the area, type and capacity of the tank, type of dispenser, reasons for the intervention)
  4. tank calibration table showing the actual capacity of each tank
  5. photographic documentation on the state of the sites subject to intervention;
  6. (only if the owner of the area does not coincide with the owner of the plant) copy of the deed certifying the availability of the area;
  7. signed copy of the information notice pursuant to Articles 13 and 14 of EU Regulation no. 679 of 2016;
  8. copy of the valid identity document of the signatory of the SCIA (if the documentation is not digitally signed).

Please note that at the same time as the SCIA, the Certification of the qualified technician certifying the regularity of the installation must be submitted by the professional appointed by the company. See the Further Information section for submission methods.

For installations for private use with a theoretical capacity of more than 10 cubic metres, the application for authorisation must be submitted, with the following attached

  1. map extract of the area on which the plant will be built, signed by a qualified technician;
  2. project of the plant complete with plans, plans, sections, elevations, on an appropriate scale, signed by a qualified technician;
  3. photographic documentation relating to the state of the sites subject to the intervention;
  4. technical-illustrative report in which the works to be carried out are accurately described, signed by an authorised technician containing at least the following information (land registry identification, ownership and urban destination of the area, type and capacity of the tank, type of dispenser, reasons for the intervention)
  5. calibration chart of the tanks that will be installed;
  6. signed copy of the information notice pursuant to Articles 13 and 14 of EU Regulation no. 679 of 2016;
  7. copy of valid identity document (if the documentation is not digitally signed).

Forms

Timeframes and deadlines

There are no deadlines or deadlines.

90 days

Maximum no. of waiting days

starting from the day after receipt of the permit application (installations with a total capacity of more than 10 cubic metres).

The competent office, within the deadline indicated, will authorise/not authorise the installation and notify the applicant by PEC. Please note that the authorisation must be attached to the request for the "building permit" required to carry out the tank installation works (the request must be submitted to the municipality)

Failure on the part of the structure to comply with the procedural deadline allows the interested party to apply to the General Manager of the Department of Crafts, Commerce, Promotion, Sport and Tourism to urge the conclusion of the procedure.

Please note that in the case of authorisations, in order for the authorisation to be effective, it is necessary that within 30 days from the end of the installation work the technician's certification attesting to the conformity of the installation with the authorisation be forwarded to the competent office (see the service sheet).

In the case of SCIA submissions (installations with a total capacity of up to 10 cubic metres), the activity may be commenced the day after the report is sent, provided that the technical certification by the professional appointed by the company has also been sent. Within 60 days from the submission of the SCIA, the competent office verifies the requirements and prerequisites for opening the plant. If the outcome of the verification is negative, it notifies the interested party by PEC communication and prohibits the continuation of the activity. If the activity continues, the plant is considered unauthorised and the company may therefore be sanctioned.

Please note that for installations with a capacity of more than 5 mc it is necessary to apply for a tax licence from the Customs and Monopolies Agency.
