Description
Waste management authorisations are divided into two large groups:
- Authorisations in "ordinary procedure" (ref. articles 84, 85 bis, 85 ter, 86 bis of D.P.G.P. 26 January 1987, no. 1-41/Leg. - T.U.L.P. on environmental protection from pollution and Articles 208 and 211 of Legislative Decree 152/2006);
- Notifications of commencement of non-hazardous waste recovery activities under the "simplified procedure" (Articles 214 and 216 of Legislative Decree 152/2006 and Ministerial Decree of 5 February 1998).
1. Authorisations under the "ordinary procedure" include
- authorisations for the management of waste disposal and recovery plants (including mobile plants), authorisations for the recovery of waste consisting of excavated soil and rocks from small construction sites, cumulative authorisations for waste management, authorisations for the regularisation of authorisations relating to non-hazardous waste recovery activities and plants. See section below "Waste authorisation forms in ordinary procedure". Authorisations for the management of waste disposal and recovery plants may be subject to the Single Territorial Authorisation (AUT) or to the Integrated Environmental Authorisation (AIA) so, in case of doubt, please consult the specific Service forms: "Request Single Territorial Authorisation (AUT)" or "Request Integrated Environmental Authorisation (AIA)";
- authorisations for the agronomic use of sewage sludge. See section on forms "Authorisation forms for the use of sewage sludge in agriculture". These authorisations may also be subject to the Single Territorial Authorisation (AUT) so, in case of doubt, please consult the specific Service forms: "Request Single Territorial Authorisation (AUT)". ;
- authorisations to carry out waste storage activities at the place of production, management of vehicle scrapping centres, inert landfills. See section on forms "Authorisation request forms issued by the Municipality for waste management in ordinary procedure". These authorisations (although under municipal competence) are almost always issued as part of the Single Territorial Authorisation (AUT), so we ask you to consult the specific form "Request Single Territorial Authorisation (AUT)".. In some cases, it is necessary to apply for an integrated environmental authorisation (AIA) , so if in doubt, please consult the specific Service sheet: "Request Integrated Environmental Authorisation (AIA)"..
If the authorisation is not included in the AUT or AIA it is valid for 10 years.
2. Concerning the communication of the start of non-hazardous waste recovery activities, please refer to the Service sheet "Notification of commencement of non-hazardous waste recovery activities" ..
Since the communication is almost always included in the AUT procedure, in case of doubt consult the specific Service sheet: "Request Single Territorial Authorisation (AUT)".
If the communication is not included in the AUT it is valid for 5 years.
Restrictions
The granting of authorisation is conditional on the provision of an appropriate financial guarantee.
