How to fill in and send the application for the granting, renewal, re-examination and updating of the AIA

Description

Authorisation that must be requested by certain types of companies expressly identified by law, specifically in Annex VIII to Part Two of legislative decree 152/2006 (which mainly, but not exclusively, mentions the energy, industrial, chemical and waste management sectors).

The AIA encompasses and replaces the authorisations listed in Annex IX to Part Two of Legislative Decree 152/2006 (e.g. atmospheric emissions authorisation, waste management authorisation, discharge authorisation, etc.).

The authorisation is valid for 10 years (12 years for ISO:14001 certified companies, 16 years for EMAS certified companies).

Restrictions

Payment of an investigation fee with costs determined by the Resolution of the Provincial Council no. 1040 of 15 June 2018 on the basis of the activities carried out, the emissions produced and the pollutants to be analysed.

If the authorisation also concerns waste management activities, its granting is subject to the provision of an appropriate financial guarantee.

Who it's for

Companies whose activity falls within those listed in Annex VIII to Part Two of Legislative Decree 152/2006.

The application may be submitted by the legal representative of the company or by his delegate already identified in the Chamber of Commerce (e.g. technical director of the plant) or, a different delegate by attaching the written proxy (e.g. external consultant) to the application.

Documents to be submitted

The documentation to be submitted depends on the authorisation requested among those included in the AIA. The required annexes are listed in the AIA application form - see section 'Application form for AIA (Integrated Environmental Authorisation)'.

For new installations or in the case of re-evaluations and renewals, forms A (production capacity), B (raw materials), F (energy), G (noise) and H (pollutants and waste produced in the establishment - summary sheet) must always be attached - see section Forms "AIA (Integrated Environmental Authorisation) application form".

Depending on the activities carried out at the installation, it will also be necessary to choose the forms to be attached to the application:

"Atmospheric emissions authorisation forms":

  • Annex C.1 Atmospheric emissions - thermal plants
  • Annex C.2 Atmospheric emissions - production plants
  • Annex C.3 Atmospheric emissions - use of solvents
  • Annex C.4 Diffuse atmospheric emissions

"Authorisation forms for wastewater discharges of provincial competence".

  • Annex D Water discharges - industrial and assimilated to domestic

"Waste authorisation forms in ordinary procedure".

  • Annex E.1 Waste disposal and/or recovery activities in ordinary procedure
  • Annex E.2 Substitute declaration ordinary procedure

ATTENTION: In order to choose the correct form in the "Forms" section, look at the abbreviations put in brackets, as the same form can be used in more than one procedure. For example the "Annex C.1 Atmospheric emissions - thermal plants" is named "Annex air emission authorisation - thermal plants (AUT A.1 AIA C.1)" as it could also be used within the AUT procedure as Form A.1.

If renewal, issuance, re-examination of the AIA: the procedure will last no longer than 150 days (net of investigative suspensions) starting from the complete submission of the application including the transmission via pec of the receipt of payment of the investigative fee.If updating the AIA: the procedure will last no longer than 60 days (net of investigative suspensions) starting from the transmission via pec of the application.

The user will receive, within a few days from the submission of the application, a notice of initiation of the procedure in which the procedure is summarised and where the person in charge of the procedure and the contacts to request information and documents are indicated. The procedure will end with the issue of a determination by the Sector Manager to issue the AIA or to deny it with reasons.
