Requirements for the installation and operation of a new roadside petrol station

Description

This includes fuel distribution plants, characterised by a service open to the generality of road users, located along roads and motorways, as well as the plant intended for the service of pleasure craft at the San Nicolò port in Riva del Garda and the plant intended for the service of aircraft at the Gianni Caproni Airport.

The start-up of this type of fuel distribution plant is subject to a prior authorisation to be requested from the Province, following the acquisition of a 'favourable opinion' from the Fire Prevention and Civil Protection Service and a feasibility opinion for the opening of accesses from the road or motorway operator.

Restrictions

The applicant company, if newly established, must already be registered in the commercial register and have started business.

An administrative penalty of between EUR 5,000 and EUR 30,000 shall be imposed on anyone who
- installs and operates a road or motorway fuel distribution facility without the prescribed authorisation
- installs and operates a fuel distribution facility for pleasure craft and aircraft in the absence of the prescribed authorisation.

Please refer to the regulations for all other cases in which penalties are provided for.

What to do

The interested party sends the application by one of the following methods

  1. by sending it by email to the PEC address indicated on the form;
  2. by delivering it directly to the competent provincial structure, or to any other peripheral office of the Province
  3. by sending it by registered mail with advice of receipt;

Documents to be submitted

The following documents must be attached to the permit application

  1. map extract relating to the area on which the plant will be built, signed by a qualified technician;
  2. plan of the plant complete with plans, plans, sections, elevations, to an appropriate scale, signed by a qualified technician
  3. photographic documentation relating to the state of the sites subject to the intervention;
  4. graphic drawing of the access/egress routes to the plant and of the access/egress routes to the electric vehicle charging station, signed by a qualified technician;
  5. graphic table showing the routes that allow compliance with the rules on overcoming architectural barriers, signed by a qualified technician;
  6. technical-illustrative report detailing the works to be carried out, signed by an authorised technician;
  7. signed copy of the information notice pursuant to Articles 13 and 14 of EU Regulation no. 679 of 2016;
  8. copy of valid identity document (if the documentation is not digitally signed);
  9. declaration in lieu of affidavit of possession of the moral requisites as well as the non-existence against them of causes of prohibition, disqualification or suspension referred to in Article 67 of Legislative Decree 159/2011 (anti-mafia) issued by each of the persons indicated in Article 85 of the same Legislative Decree 159/2011.

It should also be noted that the office responsible for the preliminary investigation will have to obtain a mandatory opinion from the owner or manager of the road on which the installation overlooks. The 90 days indicated above do not include the time needed to acquire the aforementioned opinion.

The competent office, within the aforementioned term, shall authorise/not authorise the installation and operation, and shall notify the applicant by PEC. Please note that the authorisation must be attached to the request for the "building permit" required to carry out the installation works (the request must be submitted to the municipality)

Failure by the facility to comply with the procedural deadline allows the interested party to apply to the General Manager of the Department of Crafts, Commerce, Promotion, Sport and Tourism to request the conclusion of the procedure.

Please note that, in order to start the dispensing activity, it is necessary that within 90 days of the end of the installation of the system, the certification of the technician attesting to the conformity of the system with what was authorised be forwarded to the competent office (see the service sheet). This certification is necessary to submit the application for the issue of the operating licence to the Customs Monopolies Agency.
