Description
The recipients of the measures for social reintegration are the inmates of the Spini di Gardolo prison, persons subject to alternative measures to detention, to substitutive sanctions, to security measures and to penal measures ordered by the juvenile judicial authorities.
In order to effectively meet the needs of these persons, the competences in the field of justice, which are the responsibility of the State, need to be integrated with those of the Autonomous Province of Trento in the field of social, health, training and labour policies. This integration, in compliance with the provisions of the implementation rule of the Statute for the Trentino - Alto Adige/Südtirol Region(Presidential Decree no. 474 of 28 March 1975, as amended) is implemented through the signing of agreements between the Autonomous Province of Trento, the Autonomous Region of Trentino Alto Adige/Südtirol and the Ministry of Justice. The most recent of these conventions is the Memorandum of Understanding 'For Social Reintegration' of July 2020. An initial planning of support measures in favour of persons subject to judicial authority measures restricting or depriving them of their personal liberty is contained in the Provincial Strategy for Sustainable Development (SproSS approved by resolution of the Provincial Council no. 1721/2021) in the chapter "Legality and the fight against crime" (p. 125).
Below are the main areas of intervention of the Autonomous Province of Trento, the Employment Agency and the Provincial Agency for Health Services in favour of persons subject to measures restricting or depriving them of their liberty.
Social policies
The Social Policies Service activates, programmes, monitors and manages the following social welfare services together with third sector organisations:
- Service "Social inclusion of persons subject to measures restricting personal liberty" for the support of persons in a situation of distress for personal, family, socio-cultural reasons connected with measures restricting personal liberty or release from prison.
- Service "Workshop for the acquisition of work pre-requisites for the inmates of the Spini di Gardolo prison" is aimed at carrying out training/work activities aimed at learning work pre-requisites, acquiring practical-manual skills, strengthening/developing skills and behaviours suitable for taking on tasks and duties in a working environment with the prospect of inclusion in protected working contexts or in the labour market.
- Service "Sowing today to harvest tomorrow 2" financed by the "Cassa delle Ammende" and co-financed by the Autonomous Province of Trento has as its object the development of social inclusion pathways(d.g.p. no. 1106 of 22 June2018 and d.g.p. no. 175 of 11 February 2022) and of training and guidance traineeships(d.g.p. no. 1953 of 24 December 2017) in favour of people undergoing criminal execution.
- Operational protocol for the extra-penitentiary reception of detained parents with children, which aims to facilitate access to extra-penitentiary reception services by detained parents with accompanying children and mother-child nuclei.
- Coordination of the Technical Operating Group "Social reintegration, family ties and culture" referred to in Article 3 of the July 2020 Memorandum of Understanding. The GTO - following the co-programming procedure relating to the social inclusion of persons subject to measures limiting their personal freedom, pursuant to Article 55 of Legislative Decree no. 117/2017 - also equipped itself with the collaborative tool identified in the "co-programming table".
Other interventions falling within the competence of the Social Policy Service, not specifically dedicated to persons subject to judicial authority measures limiting or depriving them of their personal liberty but generically aimed at people in difficulty, are low-threshold services(permanent and winter dormitories, community houses and the adult service centre), adult reception communities and high and low protection accompanied living interventions.
Education and training in prison
The Department of Education and Culture of the Autonomous Province of Trento, through the provincial school institutes, provides the school and training offer for the inmates of the Spini di Gardolo prison. The school and training offer is divided into literacy courses, middle school courses, high school courses, summer school modules and vocational training courses. This offer takes into account the specificity of the context and aims at activating sustainable paths consistent with the inmates' length of stay, as well as the activation of spendable paths and/or possibly to be completed outside prison.
The main regulatory reference is Provincial Law no. 5 of 7 August 2006, which, in Article 69 bis, provides for the stipulation of a specific protocol between the Autonomous Province of Trento and the Trento prison.
Labour Policies
The Employment Agency of the Autonomous Province of Trento finances, under Measure 3.3.C. (former Measure 18) of the "Document of employment policy interventions". C (formerly Intervention 18 of the 'Document of employment policy interventions'), individualised work integration projects for people with disabilities or disadvantages, by means of special purchase bonds (vouchers). The "disadvantaged" persons, identified by this Measure, also include prisoners, internees and those admitted to alternative measures to imprisonment and outside employment and, from February 2020, also former prisoners, former internees and former persons subjected to alternative regime to imprisonment, for whom the detention or restriction of liberty status has ceased no more than 24 months ago. These projects envisage, for the benefit of the worker, the provision of services by the employer to foster personal, social and professional growth.
Health and healthcare in prison
The Provincial Agency for Health Services (APSS) has among its tasks also the implementation of a corporate organisational model for health protection in the prison environment. This organisational model, revised in 2019, led to the establishment of the Struttura semplice medicina carceraria (Simple Prison Medicine Structure ) with direct reference to the APSS Health Management. The health organisation in prisons refers to the D.P.C.M. of 1 April 2008, which established that, from the point of view of health and health care, "the treatment of the prison population should be comparable to that of the general population" and for this reason assigned the National Health System the protection of the health of the prison population. Subsequently, the legislative decree no. 252 of 19 November 2010 'Norme di attuazione dello Statuto speciale della regione autonoma Trentino-Alto Adige concernente disposizioni in materia di assistenza sanitaria ai detenuti e agli internati negli istituti penitenziari' transferred the functions of health care in prisons to the Autonomous Provinces of Trento and Bolzano. Finally, with the d.g.p. no. 169 of 4 February 2011, the Province approved the implementation directive on health care for inmates, internees and minors subjected to penal measures in penal institutions in the territory of the Province of Trento.
The Pergine REMS
The Pergine Residence for the Execution of Security Measures (REMS) is a social-health residential facility pertaining to theOperative Unit of Psychiatry - Valsugana, Tesino, Bersntol, Val di Fiemme, Val di Fassa, Primiero and Cembra of the APSS, which hosts, for a maximum of 10 places citizens from the province of Trento and the province of Bolzano, for whom the Magistrate has established a custodial security measure because they are unaccountable offenders, due to mental illness and socially dangerous behaviour, or for whom the GIP has ordered a provisional security measure. This is a closed facility with healthcare personnel present 24 hours a day.
Permanent prison health observatory
The d.g.p. no. 990 of 18 May 2012 and subsequent modifications established the permanent Observatory on Prison Health (set up at the Department of Health and Social Policies) with the functions of monitoring the efficiency and effectiveness of health interventions, of proposing appropriate actions and intervention tools, and of carrying out epidemiological studies on the inmate population.
Provincial plan for the prevention of suicidal behaviour
At the national level, in order to address the dramatic phenomenon of suicides in prisons, the "National Plan for the prevention of suicidal conduct in the adult prison system" was prepared, adopted on 27 July 2017 by the Unified Conference of the Presidency of the Council of Ministers, which also requires planning at the regional/provincial and local level. In compliance with the national plan with d.g.p. no. 545 of 19 April 2019, the Provincial Plan for the prevention of suicidal behaviour in the adult prison system was approved. This Plan, highlighting that imprisonment is in itself a risk factor, recalls the need to adopt a holistic approach geared towards promoting the well-being and health of workers and inmates and provides guidelines for the development of the local plan. The local suicide prevention plan was signed by the APSS and the Spini di Gardolo prison in early 2020.
