Description
The provincial law on tourist accommodation lays down the obligation for those who offer houses or flats for tourist rental of which they have the availability for any reason, to submit a specific communication to the municipality responsible for the area and to update it.
The data collected feed a systematic and comprehensive database dedicated to accommodation for tourist use and managed by the Tourist Information System(DTU-Alloggi).
The communication must be submitted online, by connecting to the portal http://www.alloggituristici.provincia.tn.it and authenticating in the prescribed manner (CPS, CNS, SPID).
Restrictions
Failure to submit or incomplete submission of the communication or updates by the deadline will result in the application of an administrative penalty of between €200 and €600 for each house or flat.
It is recalled that anyone offering accommodation for tourist rental, after having made the communication, is obliged to:
- Acquire, indicate and display the CIN (see all information);
Only in the case of short-term/tourist lettings exercised in an entrepreneurial form , submit a certified notification of commencement of activities (SCIA) at the single counter for productive activities (SUAP) of the municipality in whose territory the activity is carried out.
Article 13-ter, paragraph 8, of Decree-Law no. 145/2023 introduced this obligation for anyone who, directly or through an intermediary, carries out, in entrepreneurial form, the activity of renting for tourist purposes or short-term rental of less than 30 days (pursuant to Article 4 of Decree-Law no. 50/2017 converted with amendments into Law no. 96/2017).The obligation to submit the SCIA also exists if the presumption of entrepreneurship of the activity, sanctioned by art. 1, paragraph 595, of law no. 178/2020, operates for those who offer more than four flats for short term rental in each tax period.
The exercise of the short-term rental/tourism business in entrepreneurial form is in any case subject to the communication referred to in art. 37 bis of Provincial Law no. 7/2002, with consequent registration of the accommodation in the provincial database DTU-housing.For the correct creation of the registry of the company or firm, the landlord must apply directly to the territorially competent municipality. For this purpose, he may use the paper form downloadable from the forms section.
The day after this registration, the landlord must connect to the national database of accommodation facilities (BDSR) to obtain the CIN and then submit the SCIA to the territorially competent SUAP.
- Please contact the Trento Police Headquarters (0461/899700 - 0461/899701 - upgsp.tn@poliziadistato.it), which will issue the credentials for the activation of the telematic transmission of guests' personal details to the Weballoggiati portal of the Public Safety Department (Ministerial Decree 7 January 2013). - Communicate the information of arrivals and departures of guests for the purposes of the ISTAT declaration by connecting to the portal www.alloggituristici.provincia.tn.it and selecting from the MENU SERVICES - ISTAT declaration (info and instructions) or contact the local Tourist Office where the accommodation is registered (see ISTAT contact list);
- Collect the tourist tax. The amount to be charged by the landlord to the tourist is Euro 1.00 per person per overnight stay for a maximum of 10 consecutive days at the same accommodation.
