Licence for the use of the trademark Parco Naz. dello Stelvio - Trentino in return for payment

With a view to the sustainable development of the territory, the Park may grant a licence to use its mark against payment to natural or legal persons, who obtain the right to use it in exchange for the payment of a fee, in order to distinguish their production of goods or services.

he Park's mark may be granted, indicatively but not exhaustively, for

• agri-food products
• handicraft products
• personal wellness products
• tourist services

Recipients of the trade mark licence may not further assign its use to third parties.

The following may apply for a licence to use the mark against payment

• agricultural and forestry enterprises, individually or in association, operating in the territory of the administrative municipalities included in the Park
• enterprises of the tertiary sector, bodies and associations other than Third Sector Bodies, that promote local production and produce goods, services and products in the territory of the administrative municipalities included in the Park, consistent with the Park's aims and activities as well as with sustainable development
• agri-food and craft enterprises, falling under the definition of micro-enterprises and SMEs of the EC, that valorise typical agricultural and craft productions
• entities managing tourist accommodation facilities

Goods, services and products

The licence to use the Park's mark may be granted if the product is already subject to recognition or compliance with certifications, guidelines, protocols or good practices related to environmental quality and, in the case of products only, if in addition at least one of the following conditions is met

• the production process, referring both to the raw material and to the processing, takes place entirely within the territory of the administrative municipalities included in the Park
• the manufacturing process takes place outside the territory of the Park, but the raw materials come entirely from the territory of the administrative municipalities included in the Park
• the processing takes place within the territory of the administrative municipalities included in the Park, but the raw materials, although fundamental for the production of the product itself, are not grown or produced in the territory of the Park.

Non-receptive tourist services

The conditions for obtaining the licence to use the Park's mark are the operation within the territory of the administrative municipalities included in the Park, in addition to the requirement of the possession of recognitions or compliance with certifications, guidelines, protocols or good practices related to environmental quality.

Accommodation Facilities

The Park's mark may be granted to the following categories of accommodation facilities located in the territory of the administrative municipalities included in the Park

• hotel and non-hotel structures, excluding holiday houses and flats, condhotels
• campsites
• alpine and excursion refuges
• agritourism facilities

In the accommodation sector, the licence to use the mark may be granted to accommodation facilities that, at the time of application, already enjoy forms of recognition or compliance with certifications or already adhere to protocols related to environmental quality.

The accommodation facilities to which the licence to use the mark is granted, when submitting the application, undertake to ensure and prove, at the time of inspection, the following fulfilments

• the organisation of initiatives and actions consistent with sustainable development and with the purposes and activities of the Park;
• the participation in dissemination and training initiatives promoted by the Park;
• the display in common areas of information material provided by the Park and the provision to guests of publications or other consultable material on the Park and its territory.

The licence contract for the use of the mark shall be stipulated, also by exchange of correspondence in the forms of commercial use, with the Manager of the Provincial Service responsible for protected areas.

The application shall be sent to the Management Office of the Stelvio National Park - Trentino using the appropriate form (see below)

The application for a licence to use the mark, drawn up on the appropriate application form, shall contain all the elements needed to allow the Park to assess its eligibility.

The application for a licence to use the mark shall be accompanied by

• the corporate presentation
• the presentation of the product, service or accommodation for which the licence to use the mark is requested, including indicative information on the dissemination of the products or services or the use of the accommodation
• the presentation of the methods of application and use of the mark, also with reference to the possible combination with any corporate or territorial marks, with graphic or photographic representation;

The time limit for the procedure is set at 45 days from the day after receipt of the complete application with annexes.

The licence to use the mark shall have the duration established in the relative contract and in any case not more than three continuous years. The user licence contract may be renewed once only for a period established in the contract not exceeding the original duration of the same on the express request of the interested party, which must be presented to the Stelvio National Park - Trentino Management Office no later than the 60th day prior to the expiry of the previous contract.

Renewal is granted within 30 days from the presentation of the application, subject to verification that the requirements have been maintained.

The fees due for the licence to use the Park's trade mark with regard to goods, products, services and accommodation facilities are determined by a resolution of the Provincial Council.

The licence to use the mark is free of charge:

• for accommodation facilities, in case of adherence to a certification or specification recognised by the regulations and consistent with the objectives of sustainable tourism in the protected areas, valid at the moment of the application for the licence to use the mark or for its renewal
• for mountain huts.
