Grants to municipalities for urgent prevention measures

Granting of subsidies to municipalities to carry out urgent prevention works consequent and consecutive to a calamitous event that has already occurred and that are necessary to contain the continuation or aggravation of the risk or the occurrence of new risks.

The municipality, once the report or the final/executive project of the works has been filed, must wait for the Risk Prevention Service and single emergency centre to qualify the intervention as urgent prevention in order to submit an application.

The Municipality, in the presence of a dangerous situation requiring urgent prevention works, draws up the project and submits it to the Risk Prevention and Single Emergency Service, requesting that it be qualified as urgent prevention. In the presence of a positive response from the competent Provincial Service, the Municipality, within the established deadline, submits an application for a contribution, using the form published on the Province's institutional website, by one of the following methods

• direct delivery to the competent structure
• transmission by postal service, by registered letter with advice of delivery. For the purposes of compliance with the deadlines, the date of dispatch shall be taken as the date of dispatch;
• (preferably) transmission by telematic means, in compliance with the relevant technical rules, via P.I.Tre. interoperability or to the address: serv.prevenzionerischi@pec.provincia.tn.it

The application for assistance, drawn up according to the appropriate form, must be accompanied by

• photographic documentation showing the state of the sites
• signed copy of the technical and economic/executive feasibility project;
• signed copy of the decision approving the technical and economic/executive feasibility project;
• if the project item "sum available" provides for the purchase or expropriation of real estate or land whose amount is equal to or greater than 50% of the investment: copy of the deed of the competent body approving the acquisition of the real estate; for purchases: appraisal; for expropriations: estimate of the expropriation costs.

The outcome of the procedure is formally communicated to the requesting municipality, indicating the reference of the measure and the site where the measure is published.

In the event of a negative outcome, the Municipality may file

• appeal to the Regional Administrative Court, within 60 days from the notification/communication of the act, pursuant to Law no. 1034/71;
• extraordinary appeal to the President of the Republic, within 120 days of the service of the act, pursuant to Presidential Decree no. 1199/71.
