Supplementary contribution for emergency, prevention and preventive measures

Application for the integration of the contribution following a variant for the execution of works of

• extreme urgency (l.p. 9/2011, art. 37, par. 1)
• prevention (l.p. 2/1992, Art. 7, par. 1 and 4 - l.p. 9/2011, Art. 84, par. 6);
• urgent prevention (l.p. 2/1992, Art. 7, paras. 1a, 1b and 4 - l.p. 9/2011, Art. 84, par. 6).

Project variations that entail a cost overrun are eligible for the grant, subject to the authorisation of the competent Risk Prevention Department, if they derive from additional works that are strictly necessary to consider the intervention functional and compliant with the purposes for which the grant was awarded.

The Municipality, in order to supplement the contribution already granted, shall submit an application by one of the following methods

• direct delivery to the competent structure
• transmission by postal service, by registered letter with acknowledgement of receipt. For the respect of the deadlines the date of dispatch shall be considered the date of sending;
• (preferably) transmission by telematic means, in compliance with the relevant technical rules, via P.I.Tre. interoperability or to the address: serv.prevenzionerischi@pec.provincia.tn.it

The application for a grant supplement, drawn up according to the appropriate form, must be accompanied by

• signed copy of the appraisal and design drawings of the variant works;
• economic framework comparing project, contract and variant;
• signed copy of the order approving the works variant appraisal.

The outcome of the procedure is formally communicated to the requesting municipality, indicating the reference of the measure and the site where the measure is published.

In the event of a negative outcome, the Municipality may file

• appeal to the Regional Administrative Court, within 60 days from the notification/communication of the act, pursuant to Law no. 1034/71;
• extraordinary appeal to the President of the Republic, within 120 days of the service of the act, pursuant to Presidential Decree no. 1199/71.
