Pursuant to Article 49, paragraph 1 of Provincial Law no. 9 of 1 July 2011, the following may be registered (registration in section C of the list)

a) voluntary organisations constituted in accordance with Provincial Law no. 8 of 13 February 1992, having a local character and operational headquarters in the Province of Trento

b) organisations of a different nature provided they have a predominantly voluntary component, are local and have their registered office in the province of Trento;

c) local branches of organisations falling under categories a) and b), having a supra-regional or national scope, operating in the province of Trento with organisational, patrimonial and accounting autonomy;

d) territorial coordinations that bring together several organisations falling under the above-mentioned types.

In the application for registration, voluntary organisations must declare that

a) they possess the following characteristics as set out in the memorandum of association

1. the absence of profit-making purposes

2. the predominant presence of the voluntary component

3. the performance of civil protection activities;

(b) they are characterised by the absence, on the part of legal representatives, administrators and holders of operational management positions, of criminal convictions that have become final, for offences entailing disqualification from public office;

(c) they guarantee the performance of their activities throughout the province in a manner appropriate to the nature and type of tasks to be performed

(d) they are able to guarantee constant availability throughout the year, 24 hours a day, with a number of units proportionate to the characteristics of the activity to be performed

(e) have been established and operational for at least two years

(f) they carry out their activities in compliance with the regulations in force.

The same application must contain a declaration, drawn up in the form of a declaration in lieu of a notarial deed, certifying the participation of the organisation, after activation by the competent authority, in the two years preceding the year of submission of the application, in civil protection activities and interventions of provincial and local interest.

The voluntary organisations referred to in Article 2, paragraph 1), letter a) of the implementation criteria of Article 49 of lp9/2011 must also be in possession of the requirement of the democratic nature of the structure and the electivity of the associative offices.

 

Pursuant to Article 49(2) of Provincial Law No. 9 of 1 July 2011, they may also be registered in the list (registration in Sections A and B of the list):

- volunteer fire brigades, their unions and the federation of volunteer corps

- the voluntary organisations which had an agreement with the Province, pursuant to Article 10 of Provincial Law no. 2 of 10 January 1992, at the time of the entry into force of Provincial Law no. 9 of 1 July 2011 "Regulations governing civil protection activities in the Province of Trento".

The structure responsible for risk prevention examines the application and the documentation produced by the civil protection voluntary organisation, in particular ascertaining the existence of the requirements, and within 45 days adopts the final decision.

The list is divided into 3 sections
a) the first section relating to the voluntary organisations which had an agreement with the Province, pursuant to Article 10 of the provincial law of 10 January 1992, no. 2, at the time of the entry into force of the provincial law of 1 July 2011, no. 9 and ss. mm. b) the second section relating to the volunteer fire brigades, their unions and the Federation of volunteer fire brigades

a) company name, registered office, operational headquarters and any secondary offices of the organisation
b) tax code;
(c) indication of the president and officers
(d) indication of the requirements under the articles of association or memorandum of association to become a member of the organisation
(e) number of members of the organisation and their areas of employment;
(f) specific training levels of the members with reference to their significant experience in civil protection
(g) endowment of available instrumental resources and means.

The competent structure for risk prevention will proceed to the cancellation of the civil protection voluntary organisations registered in the provincial list in the case of
a) submission of an application for cancellation
b) loss of one or more of the requirements for registration;
c) failure to fulfil the obligations imposed on the organisation by the regulations in force and by the present criteria.

Organisations registered on the list are required to promptly notify the competent Risk Prevention Department of any changes to the data and information indicated in Article 7 of the Criteria, also for the purposes of
purposes of the provisions of Article 6 of the Criteria.

Within 20 days of receiving notification of the change in the data and information on the list, the competent risk prevention structure shall update the same.

In order to ensure that the organisations are adequately employed in the civil protection and related activities, every three years the Province is responsible for requesting the verification of the data and information contained in the list and also for carrying out inspections at the registered organisations' operational sites.
