Description

Paintball is a recreational sporting practice that involves conquering the opponent's base by hitting him with balls of colouring substance fired by means of special compressed air equipment, called markers.

The use of markers is regulated by Article 2, third paragraph of Law No. 110 of 18 April 1975, Ministerial Decree No. 20 of 17 February 2020, the circular of the Ministry of the Interior - Department of Public Security of 5 February 2021 and Legislative Decree No. 121 of 29 September 2013.

When this activity is carried out in specially equipped fields with a clear delimitation of the playing area and the activity is managed with entrepreneurial traits, it is necessary for the interested party to apply for an operating licence from the Provincial Administrative Police Service (ex art. 68 T.U.L.P.S.), which requires the Provincial Supervisory Commission on Theatres and Other Public Entertainment Venues (ex art. 80 T.U.L.P.S.) to verify the fitness of the court, and send the appropriate notice to the local Public Safety Authority (ex art. 123 T.U.L.P.S. Enforcement Regulations).

The form may be delivered by hand, posted or sent by certified mail to the following address: serv.polamm@pec.provincia.tn.it.

If it is not submitted by hand, it must be accompanied by a photocopy of the applicant's identity document. If the applicant is a non-EU citizen, a photocopy of a valid residence permit must also be produced.

The issue of the licence is subject to the payment of stamp duty. Therefore, two €16.00 revenue stamps must be produced together with the form.

In the case of exemption from stamp duty (e.g. O.N.L.U.S. - sports federations - sports promotion bodies and non-profit amateur sports associations and societies recognised by the C.O.N.I.), the application must indicate the details required by law.

In the case of an application transmitted via an electronic mailbox (certified or simple), the applicant must sign it, either with a digital signature or with a handwritten signature; in the latter case, after signing it, he must scan it ("scanning it") and transmit it together with a copy of an identity document. The revenue stamps must be affixed to the application and cancelled; alternatively, the details of the revenue stamps (day and time of issue, 14-digit identifier) may be indicated on the application.

- descriptive report on the rules of the game, safety management (briefing with users, presence of a field assistant, way of delivering the marker, etc.).

- plan of the venue including all the facilities present (fencing, storage areas, toilets, etc.)
- technical report documenting compliance with the Ministerial Decree of 17 February 2020, the placement of signs indicating safety regulations, the characteristics of the markers (as per the certificates issued by the manufacturer), the characteristics of the gelatine balls (ammunition), which must be biodegradable, non-toxic and environmentally friendly, etc.

Any inspection by the Provincial Surveillance Commission is subject to prior payment of the amount of: € 200 (temporary structures)/ € 250 (permanent structures). For this, a special PagoPA notice will be prepared by the Provincial Administrative Police Service at the time of the request.
