Opinion for fixed structures (such as theatres, cinemas, meeting rooms, auditoriums, museums or art galleries, discotheques or dance halls, sports facilities, swimming pools, acrobatic parks, etc.) and for temporary structures (such as marquees, grandstands, sheds intended for a certain period of time as public entertainment premises, etc.).In accordance with Article 80 of Royal Decree no. 773 of 18 June 1931 (T.U.L.P.S.), the permit is issued with a special determination, subject to the favourable opinion of the Provincial Supervisory Commission for theatres and other public entertainment venues. Description

With this eligibility, the aforementioned facilities may host one or more of the following public entertainment activities: conventions, concerts, dancing, theatrical performances, film/digital projections, sports events, exhibitions/shows, etc.

If the venue has a capacity of less than 200 persons, the procedure is simplified and it is sufficient to attach the LOC form to the application. This form replaces the inspection by the Provincial Commission of Vigilance on theatres and other public entertainment venues; the qualified technician, enrolled in the relevant professional roll, who draws it up, must also verify compliance with the prescriptions imposed by the Commission in its opinion on the project (if issued), compliance with urban planning/building regulations and the presence of a suitable certificate of fire compliance for the activity, if required by Presidential Decree no. 151 of 1 August 2011.

An application must be submitted together with the required technical documentation, which, if the venue has a capacity of less than 200 persons, is replaced by the LOC form alone.

The form may be delivered by hand, posted or sent by certified mail to the following address: serv.polamm@pec.provincia.tn.it.

If it is not produced by hand, it must be accompanied by a photocopy of the applicant's identity document. If the applicant is a non-EU citizen, a photocopy of a valid residence permit must also be produced.

The issue of the licence is subject to the payment of stamp duty. Therefore, two € 16.00 revenue stamps (three for acrobatic parks - one must be affixed to the application and the other(s) attached) must be produced together with the form.

In the case of exemption from stamp duty (e.g. O.N.L.U.S. - sports federations - sports promotion bodies and non-profit amateur sports associations and clubs recognised by the C.O.N.I.), the details required by law must be indicated in the application.

In the case of an application transmitted via an electronic mailbox (certified or simple), the applicant must sign it, either with a digital signature or with a handwritten signature; in the latter case, after signing it, he must scan it ("scanning it") and transmit it together with a copy of an identity document. The revenue stamps must be affixed to the application and cancelled; alternatively, the details of the revenue stamps (day and time of issue, 14-digit identifier) may be indicated on the application.

Withregard to urbanplanning aspects, it is necessary to verify, with the competent Municipality, urban planning compatibility/conformity (also with reference to the parking parameter) in relation to the entertainment/entertainment activity requested.

A) For premises with a capacity of less than 200 people

Form no. 004436 (LOC)

Replaces the inspection by the Provincial Commission of Supervision over theatres and other public entertainment venues pursuant to Presidential Decree no. 311 of 28 May 2001; the qualified technician, enrolled in the relevant professional register, who draws it up, must also verify compliance with the prescriptions imposed by the Commission when issuing the opinion on the project (if issued), compliance with urban planning/building regulations and the presence of a suitable fire prevention compliance certificate for the activity, if required pursuant to Presidential Decree no. 151 of 1 August 2011.

B) For premises with a capacity of more than 200 persons, an inspection by the Provincial Supervisory Commission is required. In this case, the documentation to be produced, in addition to the application, is as follows

- 1 copy of the project, signed by qualified technicians enrolled in the relevant professional registers within the scope of their respective competences, in the event that variations have been made during the course of work with respect to the initial project approved by the Provincial Commission of Vigilance; in the event that the project has never been submitted to the Commission for its prior opinion, the documentation to be produced is that listed in the instructions for the project opinion

- declaration of conformity of the electrical system, drawn up by the installer pursuant to Article 7 of Ministerial Decree 37 of 22 January 2008, complete with the mandatory annexes;

As regards static aspects

- static test of the structure subject to the inspection, from which the allowed overloads - according to the intended use - on the various structures (floors, stairs, parapets, escape routes, balconies, stages, platforms, etc.) can be expressly highlighted

- in the event that the room is underneath, in whole or in part, a car park: a declaration stating the type of motor vehicle allowed in the car park above and its maximum permissible accidental load (a clearly visible sign must be installed at the entrance to the car park, indicating the maximum permissible load and the type of motor vehicle allowed to enter)

- in the case of the use of supports for loudspeakers, videos, spotlights, pictures, etc.: declaration stating the operating load and the maximum load allowed on the structures (these load data must be indicated on the supports)

- if there are glazed parts: a declaration by the designer or Works Manager certifying that the glazing installed complies with the UNI 7697 standard; a declaration by the installation company that the glazing has been installed correctly, stating the type and location of installation; certification by the manufacturer of the characteristics of the glass used with respect to the UNI-EN standards.

In addition, for acrobatic parks

- inspection certificate - inauguration performed by an accredited type A inspection body;

- updated tree assessment report (before the seasonal opening).

The following documents must be kept at the acrobatic park for possible inspections

- inspection certificate - inauguration performed by accredited type A inspection body

- updated tree assessment report (carried out before the seasonal opening);

- updated annual inspection report (carried out before the seasonal opening);

- risk assessment and emergency plan according to UNI 15567-2;

- file with daily management sheets;

- accident register;

- PPE inspection register according to UNI 15567-2;

- manufacturer's manuals (relating to the routes).

Please note that the inspection is subject to prior payment of: 200 (temporary structures)/ € 250 (permanent structures).

This payment shall be made

  1. either by direct payment to the treasury account of the Autonomous Province of Trento, exclusively at the counters of the Treasurer in charge of the Pat - UniCredit S.p.A., specifying the following data: BANK code (5079), ENTE code (400), and, as reason for payment, "Sopralluogo Commissione provinciale di vigilanza" (Provincial Supervisory Commission inspection);
  2. or via the pagoPA platform - the national node for electronic payments:
  • directly online; it is necessary to connect to mypay.provincia.tn.it, select the entity "Provincia Autonoma di Trento"; enter the "Codice Avviso" (unique code for the individual payment indicated in the last line of the notice) and finally choose the preferred payment channel;
  • alternatively, you can show the notice for digital payment at bank counters, Sisal and Lottomatica circuits (tobacconists) or at other counters and/or channels enabled to PagoPA.
