Communication for opening or changing an agency other than extrajudicial debt recovery

Description

Business agencies are understood to be undertakings, however organised, that exercise for profit an intermediary activity aimed at concluding a business deal of any kind in the interest of others.

The elements characterising business agencies are therefore
- the organised and habitual exercise of the activity in a professional capacity
- the provision of the work to anyone requesting it;
- the activity of intermediation.

Over the years, special rules have gradually been introduced for quite a few types of agency, which have been governed by sectoral rules and thus variously regulated, subtracting them from the general public security rules (e.g. employment agencies, insurance agencies, press agencies, car practice agencies, real estate agencies, travel agencies, etc.), contained in the Consolidated Law on Public Security approved by Royal Decree No. 773 of 18.6.1931.

What to do

Fill in the communication using the appropriate forms, which may, complete with the enclosures provided, be delivered by hand, sent or sent by certified mail to the following address: serv.polamm@pec.provincia.tn.it.

The communication must be accompanied by a photocopy of the planimetry conforming to the actual state and/or eventual location of the exhibition, with the identification data noted (also necessary in the event of transfer of the activity, extension/reduction of the surface area intended for the activity)

The communication is valid exclusively for the purposes of Article 115 of the Consolidated Law on Public Security and does not exempt from the obligation to acquire any further authorising titles (licences, authorisations, concessions, inspections, permits, entries in public registers or registers, etc.) provided for by other sector laws in order to carry out the activity concerned (urban planning/building/health regulations/fire prevention/etc.).

It entails the obligation to regularly keep the register referred to in Article 120 of the TULPS, which may also be kept by computer, endorsed by the Public Safety Authority. In this case, Public Security Authority means:
- the President of the Province, operationally the Provincial Administrative Police Service if the activity is carried out in the Municipality of Trento;
- the Commissioner of Public Security if the activity is carried out in the Municipalities of Rovereto and Riva del Garda;
- the Mayor if the activity is carried out in the remaining Municipalities.

Documents to be submitted

- Form No. 004477 (communication for new opening)

- Form No. 004478 (communication for variations)

- Form No. 004479 (table of operations) signed by the proprietor, with the relevant fee schedule, duly completed;

- Photocopy of the plan in conformity with the state of affairs, signed by the proprietor, of the premises where the activity is carried out and/or possible place of exhibition, with identification data noted (necessary in the case of transfer of the activity, enlargement/reduction of the surface area allocated to the activity);

- Register (business journal), pursuant to Article 120 of the Consolidated Law on Public Security, which may also be kept in computerised form, for endorsement pursuant to Article 16 of the Consolidated Law on Public Security.

To be produced only if the owner does not complete the last item of the declaration in the communication (the one following the table showing the names of the members).

Declaration in lieu of certification and affidavit completed by each partner, accompanied by a photocopy of an identification document of the signatory. If this is a non-EU citizen, a photocopy of a valid residence permit must also be produced.

To be produced only if the owner appoints a representative, indicating this in the communication.

Only those documents, listed above, that are relevant to the application should be attached to it.

Substitute declarations are subject to random checks, as well as to compulsory spot checks in all cases in which there are reasonable doubts as to the truthfulness of the declarations made or if elements are brought to light that indicate the vagueness of the situation described.

The declared activity may commence from the date on which the communication is submitted or sent by registered letter with advice of receipt, without prejudice to the fulfilments relating to the keeping of the public security register.
