Grants to municipalities for prevention measures

Granting to the municipalities of contributions for the implementation of the preventive works referred to in Article 7 of Provincial Law No. 2/1992, aimed at preventing the occurrence on the provincial territory, for whatever reason, of situations involving serious damage or the danger of serious damage to the safety of persons, property, settlements and the environment and which, due to their nature, extent or extension, must be tackled through the intervention of the public administration.

In order to apply for a contribution, the municipality has to wait for the Provincial Council to approve the Plan of municipal investments of provincial importance for disaster prevention works.

The deadline for submitting the grant application is established by the decision of the Provincial Council approving the Plan of municipal investments of provincial importance for disaster prevention works.

Municipalities that have to carry out prevention works to cope with a calamitous event, that have already submitted a project to the Risk Prevention and Single Emergency Service and that, following the preliminary investigation, this project has been included in the list of interventions that can be financed, pursuant to Article 7 of Provincial Law no. 2/1992, with the attribution of a priority score.

The Risk Prevention and Single Emergency Service periodically updates the list of interventions that can be financed on the basis of new projects presented by the municipalities.

The Provincial Council consequently updates and approves the Plan of municipal investments of provincial importance for disaster prevention works. Following the adoption of this Plan, the Municipality, within the prescribed deadline, submits an application for a contribution, using the form published on the Province's institutional website, in one of the following ways

• direct delivery to the competent structure
• transmission by postal service, by registered letter with advice of delivery. For the purposes of compliance with the deadlines, the date of dispatch shall be taken as the date of dispatch;
• (preferably) transmission by telematic means, in compliance with the relevant technical rules, via P.I.Tre. interoperability or to the address: serv.prevenzionerischi@pec.provincia.tn.it

The grant application, drawn up according to the appropriate form, must be accompanied by

• signed copy of the technical and economic/executive feasibility project
• signed copy of the order approving the technical and economic feasibility/execution project;
• if the project item "sum available" includes the purchase or expropriation of real estate or land the amount of which is equal to or greater than 50% of the investment: copy of the deed of the competent body approving the acquisition of the real estate; for purchases: sworn appraisal; for expropriations: determination of the expropriation indemnity carried out by the competent Service for expropriations of the Province or appraisal prepared by the Municipality and endorsed by the competent Service for expropriations of the Province

The outcome of the procedure is formally communicated to the requesting municipality, indicating the reference of the measure and the site where the measure is published.

In the event of a negative outcome, the Municipality may file

• appeal to the Regional Administrative Court, within 60 days from the notification/communication of the act, pursuant to Law no. 1034/71;
• extraordinary appeal to the President of the Republic, within 120 days of the service of the act, pursuant to Presidential Decree no. 1199/71.
