Fuel: roadside distribution plant changes

The following changes affecting roadside petrol stations must be notified to the Province
(a) the transfer of ownership of the installations;
(b) the disposal of the installations
(c) change of the name/company name of the proprietor company
d) any changes made to the installations that fall within the cases of:
-replacement of single or double dispensing columns with double or multiple dispensing columns and vice versa, for products already authorised;
-increase and decrease in the number of inlets, for products already authorised, excluding methane gas and LPG
-installation of credit card acceptors;
-change of destination of the inlets, for products already authorised, with the exclusion of methane gas and LPG;
-changing the destination of tanks from petrol to diesel and changing the mechanical connections;
-installation of post-payment self-service equipment, as well as pre-payment self-service equipment or extension of existing equipment to other already authorised products;
-installation of electric vehicle supply columns;
-changes in the quantities of lubricating oil or waste oil stored;
-transformation from manned to unmanned installation;
-any other change to the facility's oil equipment not expressly listed as partial refurbishment (i.e. cases of: upgrading with new fuels; depowering with the elimination of fuels; addition, replacement or elimination of one or more tanks; changes in the storage capacity of tanks or their positioning for products already authorised; changes in the use of tanks) or total refurbishment (i.e. the removal and simultaneous relocation within the same area or in contiguous areas of all tanks and other plant components, using the same equipment or installing new equipment).

For partial or total refurbishment, please refer to the specific form available in the "Further Information" section at the bottom of this page.

The "Communication of change of name/company name" form must be submitted when the name and/or company name of the company owning the plant changes without changing the VAT Registration Number, otherwise the "Communication of transfer of ownership of the plant" form must be submitted.

Finally, it should be noted that in the case of decommissioning of plants, since dismantling must be carried out within one year from the date of decommissioning, in cases of serious and justified needs, an extension to dismantling may be requested for a maximum of six months by means of the form "Application for Extension of Dismantling Deadline".

Failure to dismantle the distribution system within the prescribed time limit is punishable by a fine of 1,000 to 6,000 euro.

A penalty of between EUR 100 and 600 shall be imposed on anyone who makes changes that do not constitute partial or total renovation in the absence of a notification.

Anyone who closes the fuel distribution facility without the required notification shall be liable to an administrative penalty of a sum of between EUR 50 and 300.

The operation of the installation in the absence of the notification of transfer of ownership is assimilated to the operation in the absence of authorisation and, therefore, is subject to an administrative sanction of between €5,000 and €30,000

All companies and local public administrations needing to communicate a variation concerning a roadside petrol station they own.

The notification of a change of name/company name must be submitted via the portal https://www.impresainungiorno.gov.it/. A guide on how to complete the online application is available at the end.

The interested party shall submit the other communication by one of the following means

1. by sending it by email to the PEC address indicated on the form;
2. by delivering it directly to the competent provincial structure, or to any other peripheral office of the Province
3. by sending it by registered mail with advice of receipt;
4. by sending it by fax to 0461/494747.

Please note that, if sent electronically, the forms must always be transmitted in a static PDF format that cannot be modified.

Notification of changes to the installation (to be submitted if the changes do not constitute partial or total renovation):

1. current state/future state table with evidence of the modifications, on an appropriate scale, signed by qualified technician
2. technical-illustrative report detailing the works to be carried out, signed by a qualified technician;
3. privacy policy in accordance with EU Regulation no. 679/2016
4. copy of valid identity document (if documentation is not digitally signed)

The communication of transfer of ownership of the authorisation must be accompanied by

1. plain copy of the deed between living persons;
2. declaration in lieu of affidavit of the possession of the moral requirements as well as the non-existence against him/her of causes of prohibition, disqualification or suspension referred to in Article 67 of Legislative Decree no. 159/2011 (anti-mafia) issued by each of the persons indicated in Article 85 of the same Legislative Decree 159/2011
3. signed copy of the information notice pursuant to Articles 13 and 14 of EU Regulation no. 679 of 2016.
4. copy of valid identity document (if the documentation is not digitally signed)

Notice of change of company name must be submitted via the online procedure.

The communication of decommissioning of the installation must be attached:

1. communication of the quantities of fuel dispensed from 1 January to the date of definitive closure
2. copy of the loading/unloading register
3. copy of the tank reclamation form, if already performed before the communication;
4. signed copy of the information notice pursuant to Articles 13 and 14 of EU Regulation no. 679 of 2016.
5. copy of valid identity document (if the documentation is not digitally signed)

The following must be attached to the application for the extension of the deadline for dismantling roadside petrol stations

1. signed copy of the information notice pursuant to Articles 13 and 14 EU Regulation No. 679 of 2016.
2. copy of valid identity document (if the documentation is not digitally signed).

The cessation of operation must be notified at least 20 days before final closure. Within a period of one year from the cessation, the plant must be dismantled (deadline extendable by 6 months - see above).

60 day maximum waiting period starting the day after receipt of the notice of decommissioning
30 days maximum waiting period starting from the day after receipt of the request for extension of the dismantling deadline or the notice of transfer of ownership.

The competent office, within the deadline indicated, will update the authorisation in the name of the applicant or grant/not grant the extension of the decommissioning deadline. The conclusion of the procedure is communicated to the applicant by Pec. Failure by the structure to comply with the deadline allows the interested party to apply to the General Manager of the Department of Crafts, Commerce, Promotion, Sport and Tourism to request the conclusion of the procedure.

In the case of notification of transfer of ownership/dismissal, the communication is verified by the competent office and forwarded to the bodies concerned. At the same time, the procedure for updating/declining the authorisation is initiated.

The other communications, on the other hand, are immediately effective without the need for any action on the part of the public administration.
