Procedures required for the refurbishment of a roadside petrol station

Description

The restructuring of a roadside petrol station is subject to a prior authorisation to be requested from the Province, following the acquisition of a "favourable opinion" from the Fire Prevention and Civil Protection Service, which is indispensable for intervening on existing plants that already have a fire prevention certificate.

Restructuring can be total (consisting in the removal and simultaneous relocation within the same area or in contiguous areas of all the tanks and other plant components, using the same equipment or installing new ones) or partial (in cases of upgrading with new fuels, depowering with the elimination of fuels, addition, replacement or elimination of one or more tanks, changes in tank storage capacity or positioning, for products already authorised, changes in tank destination).

In both cases, restructuring is subject to authorisation by the Province to be requested in the manner described below.

Restrictions

Any person who, in the case of a new opening or of total or partial renovation, operates a road or motorway service station without having submitted the technician's certification shall be subject to an administrative sanction of payment of a sum of between €500 and €3,000.

Any person who totally or partially renovates a road or motorway service station without having previously updated the authorisation shall be subject to the administrative penalty of payment of a sum of between EUR 1,000 and EUR 6,000.

Who it's for

The application may be submitted by all companies and local public administrations owning roadside petrol stations.

What to do

The interested party shall submit the application for updating the authorisation by one of the following means

  • by sending it by email to the PEC address indicated on the form
  • by delivering it directly to the competent provincial structure, or to any other peripheral office of the Province
  • by sending it by registered mail with advice of receipt.

Please note that, if sent electronically, the forms must always be transmitted in non-editable static PDF format.

Documents to be submitted

The following documents must be attached to the application for the permit update

  1. map extract relating to the area on which the plant is located, signed by a qualified technician;
  2. plan of the plant complete with plans, plans, sections, elevations, to an appropriate scale, signed by a qualified technician
  3. photographic documentation relating to the state of the sites in question;
  4. technical-illustrative report in which the works to be carried out are accurately described, signed by an authorised technician.
  5. privacy policy in accordance with EU Regulation no. 679/2016;
  6. copy of valid identity document (if the documentation is not digitally signed).

Timeframes and deadlines

Please note that it is necessary that within 90 days of the end of the renovation work on the system, the technician's certification that the system complies with the authorisation must be submitted to the competent office (see the relevant service sheet in the "further information" section).

starting on the day following the application.

It should also be noted that the office responsible for the preliminary investigation will have to obtain a mandatory opinion from the owner or manager of the road on which the installation overlooks. The 90 days indicated above do not include the time needed to acquire the aforementioned opinion.

The competent office shall, within the aforementioned period, authorise/not authorise the refurbishment and notify the applicant by Pec. Please note that the authorisation must be attached to the request for the "building permit" required to carry out the facility restructuring works (the request must be submitted to the municipality)

Failure by the facility to comply with the procedural deadline allows the interested party to apply to the Director General of the Department of Crafts, Commerce, Promotion, Sport and Tourism to urge the conclusion of the procedure.
