Documentary access to land registry documents

Documentary access, or access to documents, allows interested parties to access those administrative documents whose knowledge is necessary for the protection of a legally relevant situation.

The institution is governed by Provincial Law no. 23 of 30 November 1992 and its implementing regulation (Presidential Decree no. 17-97/Leg of 5 July 2007).

Access to administrative documents is permitted, upon presentation of a motivated request, to all persons who have a direct, concrete and current interest, corresponding to a legally protected situation linked to the document to which access is requested.

If the request for access refers to documents and/or data to which access is sought under the Transparency Decree and the national and provincial laws applying to administrative procedures, reference must be made to simple civic access and generalised civic access.

Persons interested in accessing those administrative documents whose knowledge is necessary for the protection of a legally relevant situation.

An application for documentary access must be submitted by completing and submitting, to the competent Land Registry Office, the appropriate form as follows

• form filled in by hand (or digitally), printed, signed with a handwritten signature and delivered to the competent Office (if not signed in the presence of the employee in charge, a photocopy of an identity document must be attached), or scanned and sent via your traditional or certified e-mail (PEC) box exclusively to the certified e-mail address (PEC) of the territorially competent Office, together with a photocopy of an identity document.
  The scanned and attached document must have one of the following permitted formats: PDF/A, PDF, XML, TXT, TIFF, TIF, JPEG, JPG, JFIF, JPE and EML, BMP , CSV and GIF and must not exceed 70MB in size. It is possible to send the document from a certified electronic mailbox (PEC) or from a standard mailbox.
• form filled in digitally, signed with digital signature and sent from your standard or certified e-mail (PEC) box to the PEC of the competent Territorial Office
• form filled in by hand (or digitally), printed, signed with a handwritten signature and sent by registered mail with return receipt together with a photocopy of an identity document.

The submission of the application is not subject to any cost and must be addressed to the Land Registry office with territorial jurisdiction, the references of the offices can be found below in the contact section.

The issuance of the documentation is subject to the amounts provided for the collection of special cadastral taxes and any stamp dutyfixed by resolution of the provincial council.
