The competent structure takes care of the processing of applications and verifies the eligibility of expenditure, in particular
- the adequacy of the expenditure in relation to the number of volunteers belonging to the applicant organisation
- that the insurance policy ceilings are not lower than the limits provided for in Article 2 of the Implementation Criteria of Article 54 of LP 9/2011
- that the insurance premium is congruous with respect to market values for the risk covered.
The Manager of the competent structure shall adopt the measure granting the contribution within 90 days of the deadline for submitting applications.
The payment of the contribution, subject to the cash availability of the Province, will be made in two instalments
- 70% within 30 days from the decision to grant the contribution, subject to the transmission of a copy of the insurance policy certifying the actual cash availability;
- the balance, equal to 30% of the total, within 28.2 (twenty-eight February) of the year following the year in which the advance payment was made, subject to the presentation to the competent structure of the statement of accounts certifying the proper use of the sum granted.
If during the reporting period any expenditure is found to be lower than the amount granted, the manager of the competent provincial body shall issue an appropriate deed to recalculate the grant, reducing it by an amount equal to the lower expenditure incurred, and shall order the partial cancellation of the grant.
In the event of partial revocation of the grant, the grant shall be repaid with interest calculated at the statutory rate from the date of the grant payment to the date of repayment.
The deadline for reimbursement, for justified reasons and upon request, may be extended by a decision of the Director of the competent structure for a maximum period of a further 60 days, under penalty of forfeiture of the grant awarded.
The competent structure shall order the forfeiture of the beneficiaries from the contribution, in accordance with the provisions of Provincial Council Resolution No. 1980 of 14 September 2007, in the following cases
- the interested parties have not carried out the measures for which the grant was awarded within the time limits set out in these criteria;
- the interested parties have not respected the deadline for the reporting of the expenditure.
Following the adoption of the measure ordering the forfeiture of the benefit granted to the interested party, the Provincial Administration shall recover the sums unduly disbursed in the forms provided for by the regulations in force, increased by the interest calculated at the legal rate from the date of disbursement to the date of reimbursement.
