Description
Movables and immovables of cultural interest in the possession of public entities (state property or property belonging to public entities other than the State, regions, municipalities and other territorial entities, and legally recognised entities and institutes) or non-profit legal persons (including civilly recognised ecclesiastical entities) may not be alienated until the verification of interest provided for in Article 12 of Legislative Decree 42/2004 has been carried out; without prejudice to transfers between the State, Regions and other territorial public entities.
After verification and confirmation that the assets belong to the cultural heritage, they may only be disposed of subject to authorisation that must be requested by the legal representative of the entity or legal entity also in the case of exchange and for all those legal transactions such as alienation, pledge, mortgage or easement.
On the other hand, authorisation is not required for transfers for any reason in favour of the State and the Autonomous Province of Trento (art. 6 bis L.P. 1/2003).
