Aeronautical events with a public show character or without

As a general rule, it is considered that for the purposes of the competence referred to in Article 68 of the Consolidated Law on Public Security and without prejudice to the fulfilments of the Ministry of Transport and other possible Authorities, aeronautical events assume the character of public entertainment or recreation when they are brought to the attention of the public and their influx and participation are foreseen or foreseeable.

In the case of aeromodelling, parachuting, hang-gliding, paragliding, the organisers (in particular the aeroclubs) must notify the local Police Authority (Police Headquarters in the Municipality of Trento, Police Commissioner in the Municipalities of Riva del Garda and Rovereto, Mayor in the remaining Municipalities of Trentino) of the date and characteristics of the event, at least 15 days in advance.

Where the public order authority in question considers, even if not in accordance with the declarations made by the organisers, that the event is in the nature of a public spectacle or entertainment, it must invite the organisers, pursuant to Article 123, paragraph 2 of Royal Decree no. 635 of 6 May 1940, to obtain the necessary documents for the event. 635 of 6 May 1940, to obtain the aforementioned licence prescribed by Article 68 of R.D. No. 773 of 18 June 1931, which falls within the competence (pursuant to D.P.G.P. No. 6 - 78/Leg. of 26 March 1998) of the Head of the Provincial Administrative Police Service of the Autonomous Province of Trento, and to promptly inform said Service.

The application must be submitted at least 30 days before the date of the event for which
for which authorisation is sought. To assess the documentation to be enclosed, please read the instructions below.

Please note that it is also necessary to attach the technical documentation for the opinion of the Provincial Supervisory Commission on theatres and other public entertainment venues.

- Form no. 004444 (APPLICATION)

The form may be delivered by hand, posted or sent by certified mail to the following address: serv.polamm@pec.provincia.tn.it.

If it is not produced by hand, it must be accompanied by a photocopy of the applicant's identity document. If the applicant is a non-EU citizen, a photocopy of a valid residence permit must also be produced.

The issue of the licence is subject to the payment of stamp duty. Therefore, two €16.00 revenue stamps (one for the application and one for the order) must be produced together with the form. In the case of an exemption from stamp duty (e.g. O.N.L.U.S.), the details required by law must be indicated in the application.

Depending on the type of event, facilities and location,

must be attached to the application:

FOR ALL EVENTS the opinion of the Provincial Supervisory Commission for theatres and other public entertainment venues (abbreviated C.P.V.) must be obtained by contacting geom. Luigi Cofler (0461.494820) or per.ed. Salvatore Rizzo (0461.494823).

- Form no. 004448 (TEMP FORM)

In the case of events with temporary set-ups that have already been the subject of positive verifications by the Provincial Commission of Vigilance for theatres and other public entertainment venues (abbreviated to: C.P.V.) and that have been repeated annually under the same conditions for no more than 2 years from the date of the report.

- Authorisation of the Municipality in the field of noise pollution,

pursuant to Article 11 of Presidential Decree no. 38-110/Leg. of 26 November 1998, as amended by Presidential Decree no. 43-115/Leg. of 23/12/1998, for the hours requested;

- Authorisation of the Municipality

pursuant to Art. 1, para. 7 of Provincial Law no. 5 of 12 August 1996 (for model aircraft events);

- Third party liability insurance policy;

- Approval of the Ministry of Transport - General Directorate of Civil Aviation (CIVILAVIA);

- Favourable opinion of the Aero Club of Italy

(if the application is not submitted by the same).
