Description
As a general rule, it is considered that for the purposes of the competence referred to in Article 68 of the Consolidated Law on Public Security and without prejudice to the fulfilments of the Ministry of Transport and other possible Authorities, aeronautical events assume the character of public entertainment or recreation when they are brought to the attention of the public and their influx and participation are foreseen or foreseeable.
In the case of aeromodelling, parachuting, hang-gliding, paragliding, the organisers (in particular the aeroclubs) must notify the local Police Authority (Police Headquarters in the Municipality of Trento, Police Commissioner in the Municipalities of Riva del Garda and Rovereto, Mayor in the remaining Municipalities of Trentino) of the date and characteristics of the event, at least 15 days in advance.
Where the public order authority in question considers, even if not in accordance with the declarations made by the organisers, that the event is in the nature of a public spectacle or entertainment, it must invite the organisers, pursuant to Article 123, paragraph 2 of Royal Decree no. 635 of 6 May 1940, to obtain the necessary documents for the event. 635 of 6 May 1940, to obtain the aforementioned licence prescribed by Article 68 of R.D. No. 773 of 18 June 1931, which falls within the competence (pursuant to D.P.G.P. No. 6 - 78/Leg. of 26 March 1998) of the Head of the Provincial Administrative Police Service of the Autonomous Province of Trento, and to promptly inform said Service.
