Description
Provincial Law No. 9 of 1 July 2011 “Regulation of civil protection activities in the Province of Trento” assigns to the Province the task of forecasting hazards and risks (Article 6, paragraph 3) through the drafting and updating of “hazard maps” (Article 10, paragraph 1) covering hazards associated with hydrogeological phenomena, avalanches, floods, earthquakes, forest fires, certain hazardous substances, overhead cables or other obstacles to air navigation, and unexploded ordnance.
These tools form the basis for drawing up the Summary Hazard Map (CSP), as provided for in Article 22 of Provincial Law No. 15 of 4 August 2015 (Provincial Law on Land Use Planning), which identifies areas with different risk classifications for the purposes of applying the provisions relating to land use set out in Provincial Law No. 5 of 27 May 2008, ‘Approval of the New Provincial Urban Plan’.
In particular, the Hazard Summary Map is one of the constituent elements of the Provincial Urban Plan (PUP) (paragraph 4(d) of Article 21 ofProvincial Law No. 15 of 4 August 2015, No. 15, and paragraph 1 of Article 3 of Provincial Law No. 5 of 27 May 2008) and is intended to identify areas characterised by different levels of restriction for land-use purposes, due to the presence of hydrogeological, avalanche, seismic and forest fire hazards, as described in the Hazard Maps (Article 10 of Provincial Law No. 9 of 1 July 2011 and Article 14 of Provincial Law No. 5 of 27 May 2008).
With regard to hazards, the Summary Hazard Map constitutes the new reference tool for urban planning; upon its entry into force, the provisions of the Summary Geological Map and the land-use provisions of the General Plan for the Use of Public Water Resources cease to apply (paragraph 2, Article 22 of Provincial Law No. 15 of 4 August 2015).
By Resolution No. 1340 of 12 September 2025, the Provincial Executive approved the new text of the ‘Technical Provisions for the Preparation of the Hazard Summary Map’.
These provisions, in accordance with the provisions of Article 14 of Provincial Law No. 5 of 27 May 2008, establish, on the basis of the various Hazard Maps, the technical provisions and methodology for the preparation of the Hazard Summary Map and the procedures for identifying areas characterised by different levels of risk, as well as the river basins of hydraulic interest under the General Plan for the Use of Public Waters.
The regulations governing the Summary Hazard Map stipulate that it is subject to periodic updates in line with, and concurrently with, updates to the relevant Hazard Maps.
The Provincial Executive, by Resolutions Nos.1341 and 1361 of 12 September 2025, approved the second update of the Hazard Maps and the Hazard Summary Map for the entire provincial territory, which came into force on 19 September 2025, the day following their publication in the Provincial Official Gazette (B.U.R.). On 18 September 2026, the Provincial Executive, by Resolutions Nos. 1422 and 1447, amended the previous resolutions, due to a mere clerical error regarding avalanche risk affecting only the Pampeago area in the municipality of Tesero.
The Provincial Council, byResolution No. 1361 of 12 September 2025, also approved the new, updated text of the ‘Guidelines and clarifications for the application of provisions concerning areas with high, medium or low penalties and areas with other types of penalties’, as set out in Annex C to the resolution itself.
