Description
The effective application of the EU Charter of Fundamental Rights and the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD) are preconditions for the effective and efficient implementation of Programmes financed with European funds. The fulfilment of these conditions is intended to ensure that the implementation of these Programmes complies with EU law. Compliance with the horizontal principles set out in Article 3 of the Treaty on European Union (TEU) and Article 10 TFEU, including the principles of subsidiarity and proportionality enshrined in Article 5 TEU, is ensured at both the programming and implementation stages, including through the application of the European Code of Conduct on Partnership.
The Managing Authority of the 2021-2027 ESF+ Programme of the Autonomous Province of Trento, in order to guarantee the utmost transparency and correct implementation of the Programme, shall examine any breaches of the principles set out in the Charter of Fundamental Rights of the European Union and in the UNCRPD Convention that may be found during the whole programming cycle.
In particular, in order to enable an effective supervisory function on the compliance with the principles of the Charter, the Managing Authority has appointed the Contact Point, Ms. Nina Lo Presti, contact person for the application and implementation of the enabling condition on EU fundamental rights, with the task of
- supervise the compliance of the Programme and its implementation with the provisions of the Charter; examine any complaints regarding non-compliant operations and/or complaints with respect to the Charter and, if necessary, involve the relevant bodies, also in order to identify the most effective corrective measures to be submitted to the MA
- In the event of a finding of non-compliance with the Charter, ensure the necessary follow-up actions and, at the same time, verify that appropriate measures are put in place to prevent similar cases from occurring in the future
- Periodically submit a report to the MA for the possible activation of the appropriate information procedure to the Monitoring Committee in the event of irregularities.
Moreover, in order to allow an effective supervision function on the compliance with the principles of the UNCRPD Convention, the Managing Authority
- monitors the channels for receiving complaints
- ensures a preliminary investigation of the complaint and the adoption and communication of a decision on the outcome of the investigation;
- It reports annually to the Monitoring Committee on the complaints and non-compliance reports, on the assessments carried out and the corrective measures, as well as on the implementation of the indications contained in theAct of Guidance addressed to the Programme Managing Authorities 2021-2027, drawn up by the competent national Authorities.
