Responsibilities and functions
The Provincial Vigilance Commission for theatres and other public entertainment venues is called upon to express a technical opinion regarding the safety of public entertainment and/or entertainment venues; this opinion constitutes the prerequisite required by law for the issuance of the authorisation measure.
The Commission is also entrusted with the task of supervision and subsequent control to ascertain the permanence of the verified safety standards.
Not only entertainment venues in the strictest sense (cinemas, theatres, discotheques) are subject to the Commission's inspections, but also all facilities, including precarious facilities, in which entertainment and/or entertainment activities in the broadest sense are carried out (sports facilities - exhibition halls - conference rooms).
The Commission also gives its opinion in relation to travelling attractions and tracks on which motor races are held.
Following the Commission's opinion or the envisaged technical certification in lieu of the opinion, an agility licence is issued pursuant to Article 80 of the Consolidated Law on Public Health.
Functions
The Provincial Supervisory Commission (abbreviated to CPV) - pursuant to Article 141 of Royal Decree 6 May 1940, No. 635 - performs the following tasks
- expressing an opinion on projects for new theatres and other premises or installations for public performance and entertainment, or substantial modifications to existing ones
- verifying the soundness, safety and hygiene conditions of the premises or facilities and indicating the measures and precautions deemed necessary in the interests of both hygiene and accident prevention
- ascertain compliance with the provisions in force and the visibility of signs and notices to the public prescribed for safety and public security;
- ascertain, pursuant to Article 4 of Legislative Decree No. 3 of 8 January 1998, also with the aid of technical personnel from other public administrations, the technical aspects of safety and hygiene for the purpose of registration on the list referred to in Article 4 of Law No. 337 of 18 March 1968
- frequently check that the standards and precautions imposed are observed and that the safety mechanisms are working properly, suggesting any measures to the competent authority.
