How to obtain a subsidised home loan subrogation at another bank with a contractual agreement

Article 13 bis of Annex B) of Provincial Council Resolution No 3998 of 29 March 1993, approving the implementing provisions of Provincial Law No 21 of 13 November 1992 (Disciplina degli interventi provinciali in materia di edilizia abitativa), provides for the portability of the subsidised home loan to another bank with which the agreement has been reached (subrogation).

The subsidised loan may be transferred to another subsidised bank provided that

  • the type of public contribution (constant or variable) remains unchanged;
  • the subrogation does not entail additional costs for the provincial budget;
  • the amount of the new loan does not exceed the outstanding pre-subrogation debt.

Subrogation takes effect at the beginning of the amortisation half-year (1 January, 1 July) following that in which the application for subrogation is submitted to the competent body.

It is appropriate for the subrogation application to be submitted to the relevant institution between 15 March and 31 May if the first repayment instalment at the subrogating bank (the new bank) starts on 1 July; it is appropriate for the subrogation application to be submitted between 15 September and 30 November if the first repayment instalment at the subrogating bank starts on 1 January of the following year.

What to do

The borrower identifies the agreed bank with which to transfer the current loan (subrogating bank) and submits the appropriate subrogation application to the body that granted the subsidised home loan (members of building cooperatives submit the subrogation application to the Autonomous Province of Trento - Housing Policies Service using the appropriate form, while the remaining users submit an application to their respective Comunità di valle/Territorio Val d'Adige).
