How to obtain partial access to the profession of mountain guide in the Province of Trento for providers with qualifications acquired in a foreign Member State on a temporary and occasional basis

Description

Partial access to the profession allows the professional to pursue his or her activity in Italy only in the field corresponding to that for which he or she is qualified in the Member State of origin, even if that activity is part of a broader profession regulated in Italy.

Partial access does not apply to professionals benefiting from automatic recognition.

The Italian Authority may grant partial access on a case-by-case basis where the following conditions are met

  • the differences between the professional activity legally exercised in the EU State of origin and the regulated profession in Italy must be such that the application of compensatory measures does not allow the applicant to complete the training programme required by the Italian regulations in order to have full access to the regulated profession
  • the professional activity can be objectively separated from other activities related to the regulated profession in Italy;
  • the professional must be fully qualified to exercise in the State of origin the professional activity for which he requests partial access;
  • the applicant's qualification must have been acquired in a foreign Member State, thus creating the cross-border element of the service.

When the competent authority grants partial access, the professional practises the activity under the professional title of the EU State of origin.

Partial access to the profession of mountain guide is permitted to European citizens with qualifications equivalent to the Italian training standards established for these activities.

Nationals of a Member State of the European Union and/or of the Swiss Confederation and/or State party to the agreement referred to in Law no. 300/1993 in possession of appropriate professional qualifications

What to do

Submit the declaration of temporary and occasional practice for partial access to the profession of mountain guide to the provincial tourism service via PEC: at serv.turismo@pec.provincia.tn.it

Special cases

If in the State of establishment the profession is not regulated, in addition to the above documentation, documentation attesting to the professional experience (tax or social security certification or pay slips or certification from the employer) translated into Italian or English must also be attached.

What you need

Documents to be submitted

The following documentation translated into Italian or English must be attached to the declaration of temporary and occasional operation:

  • privacy policy pursuant to Articles 13 and 14 of EU Regulation No. 679 of 2016, duly signed by the provider (canyoning guide)
  • copy of a validpersonal identity document
  • certificationfrom the competent authority stating that the holder is legally established in a Member State to carry out the professional activity and that he/she is not prohibited from doing so at the time the certificate is issued
  • copy of the training diploma obtained, certified by the body which issued it
  • a copy of the valid professional card for the relevant season
  • a document proving possession of the professional qualifications (declaration of the training body that issued the professional qualification) containing the complete programme of the training courses attended, specifying the days, hours, subjects
  • a copy of the validinsurance policy covering the risks deriving from carrying out the indicated profession, with an indication of the maximum amounts, the amount of which must guarantee adequate insurance cover for the period of activity in the province
  • certification of criminal record and pending charges (issued no earlier than six months before the date of issue)
  • a declaration by theservice provider that he has the linguistic knowledge required to practise the profession in the host Member State (Italian language), duly signed by the service provider
