Who it's for
Law 68/99 also protects the following categories of persons
- orphans and surviving spouses of persons who have died as a result of work, war, service, or as a consequence of the aggravation of the invalidity suffered as a result of such causes
- spouses and children of persons recognised as severely disabled for reasons of war, service, and work (so-called "equiparati") exclusively in substitution for the principal beneficiary
- repatriated Italian refugees (Law 763/81);
- victims of terrorism and organised crime, even if not in a state of unemployment (Law 407/98 as amended by Law 288/99)
- family members of victims of terrorism and organised crime, exclusively in substitution for the main beneficiary and even if not unemployed (Law 407/98 as amended by Law 288/99)
- victims of duty, even if not unemployed (Law No 466/80, Law No 266/2005, Presidential Decree No 243/2006)
- family members of victims of duty, exclusively in substitution for the principal beneficiary and even if not unemployed (Law No 466/80, Law No 266/2005, Presidential Decree No 243/2006)
- orphans for domestic crimes (Art. 6 Law No 4/2018)
care leavers (art. 67bis DL 34/2020)
It should be noted that orphans and children of persons recognised as severely disabled for reasons of war, service and work can be registered in the lists of compulsory employment only if, at the time of the parent's death or at the time the parent was declared permanently unable to work, they were minors or under 21 years of age, if high school students, or 26 years of age, if dependent university students. (Art. 1 par. 3 of Presidential Decree no. 333/2000).
Methods of recruitment
a) For private employers
Private employers recruit workers belonging to these categories by means of a nominative application to the competent offices.
The nominative request may be preceded by a request to the employment centres to carry out the pre-selection of the persons referred to in Article 18 of Law 68/99, who may join the specific job opportunity, on the basis of their qualifications and skills, and in accordance with the procedures agreed between the offices and the employer.
b) for public employers
Public employers recruit by competitive selection procedures and, for qualifications and profiles for which compulsory schooling is required, by means of selection as provided for by the regulations in force. (Art 7, paragraph 9 of Presidential Decree no. 333/2000).
This is without prejudice to recruitment by direct personal call for the following categories
- surviving relatives of victims of terrorism and organised crime
- surviving family members who are victims of duty
- orphans or, alternatively, the surviving spouse of those who died as a result of work.
