Description
The authorisation to open a travel and tourism agency is issued by the provincial structure responsible for tourism. It is personal, applies only to the premises indicated therein, cannot be transferred, and can be suspended or revoked for non-compliance with the relevant legal provisions.
It permits both the activity of organisation (tour-operator), intermediation and direct sales to the public and does not differentiate between in-coming and out-going activities.
Travel and tourism agencies are registered in the special list of agencies established at the Tourism Department, which is responsible for maintaining and updating it.
Restrictions
The opening of a travel agency in the Province of Trento is subject to an authorisation issued by the provincial department responsible for tourism if the following conditions are met
- Presence of a Technical Director (who may also be the owner himself) who demonstrates that he has adequate professional knowledge, in particular of the administration and organisation of travel and tourism agencies, of techniques, legislation and tourism geography, and knowledge of at least two foreign languages. He/she must meet the requirements of good repute as stipulated(by Resolution GP 2337 of 22 December 2014);
- Itmust have aninsurance policy to guarantee the exact fulfilment of the obligations undertaken towards the clients with the travel contract in relation to the total cost of the services offered, and a guarantee fund that guarantees, in the event of the insolvency of the intermediary or organiser, the reimbursement of the price paid for the purchase of the tourist package and the immediate return of the tourist;
- Having independentpremises and excluding within them other activities in any capacity whatsoever;
- The name chosen must not be the same or similar to others adopted by agencies already operating in the national territory or in any case likely to cause confusion.
