How to open a condominium hotel.

Description

Condominiums are hotel establishments open to the public, managed on a unitary basis, consisting of one or more accommodation units located in the same municipality or parts thereof.

They provide accommodation, ancillary services and possibly food, in accommodation units intended for receptive use and, in an integrated and complementary form, in accommodation units intended for residential use, equipped with autonomous kitchen service, the total surface area of which may not exceed 40 per cent of the total net usable surface area allocated to the accommodation units on 7 August 2019.

Condominiums have a single concierge desk for hotel guests and owners of residential property units, with the possibility of providing a specific, separate entrance for the exclusive use of employees and suppliers. Employees are excluded from this provision.

Restrictions

Condominium establishments must meet the minimum requirements set out in Article 2 of the implementing regulation in force.

What to do

If you are the owner of a property or intend to purchase one for hotel use, you must

  • Obtain the visa of correspondence of the project to the type of accommodation from the competent office of the Tourism Service, proving the minimum requirements provided for by the current law and its implementing regulation. The correspondence visa only certifies compliance with the parameters and requirements relating to the accommodation units and common areas intended for accommodation. In the case of variant(s) or changes that occur after the start of the work, or for the completion of the work, the applicant must submit a new application for a correspondence visa in order to obtain the relevant building permit.
  • Self-assessment with verification of the prerequisites and minimum requirements prescribed by the self-assessment declaration. (see) Determination no. 3795/2021.
  • Apply for the annotation of the condominium use restriction to the provincial structure responsible for the land register, pursuant to Article 5, paragraph 5b, of Provincial Law 7/2002.
  • Submit the SCAGI - segnalazione certificata di agibilità (certified report of habitability) required by urban planning regulations tothe competent municipality (to start the activity, contact the Office for Economic and Productive Activities or log on to Suap/Impresa in un giorno).

Special cases

The 40 per cent limit is possibly reduced in the event that the option of hiving off part of the hotel business for functionally integrated management pursuant to Article 13 bis paragraph 1 quater of Provincial Law 7/2002 is exercised
