Modification of environmental conditions Provision for EIA verification

Subject, public or private, proponent of the project and recipient of an EIA determination with environmental conditions

The application may be submitted by the legal representative of the proposing subject or by his delegate (attaching a written proxy to the application).

The competent provincial structure may modify the environmental conditions of the measure of verification of subjectivity to EIA in the case of changes in the factual situation, unforeseeable at the time of the adoption of the measure, that make it impossible to comply with the same conditions, or in the presence of technological innovations that allow for greater efficiency in their implementation.

The proposer shall submit the application for modification of environmental conditions to the O.U. for Environmental Assessments, attaching the appropriate technical-environmental documentation in electronic format.

The application form and attached documentation must be transmitted preferably by certified electronic mail to the address valamb.appa@pec.provincia.tn.it.

1. Application form duly completed and undersigned;
2. report on the existence of the prerequisites set forth in Article 5, paragraph 8 bis of Provincial Law no. 19 of 17 September 2013 (changes in the factual situation, unforeseeable at the time of the adoption of the measure, which make it impossible to comply with the same conditions, or in the presence of technological innovations that allow for greater efficiency in their implementation) and the absence of significant negative effects on the environment
3. preliminary environmental study updated to the proposed modifications prepared in accordance with Annex IV-bis to Part Two of Legislative Decree no. 152/2006 (Environmental Code);
4. list of documents - sheet A;
5. proxy of the proponent, if any.
