Description

Application to be submitted to the Sub-Commission of the Provincial Planning and Landscape Commission (SubCUP) in order to obtain

  • landscape authorisation;
  • variant to an already issued landscape authorisation;
  • opinion for the issue of authorisation concerning public works pertaining to the State or the Region;
  • further opinions or authorisations provided for by provincial regulations.

With the exception of the provisions of art. 68 for works falling within the jurisdiction of the State, the Region and the Province of Trento, works relating to airports, railway lines, motorways, new state and provincial roads, quarries and surface mines, the construction of dams, hydroelectric plants, landfills, ski slopes and relative snow basins, cableways, the laying of main non-buried pipelines for the transport of fluids, including energy fluids, and wind farms are subject to landscape authorisation by the CUP Sub-Commission.

In areas not specifically designated for settlement by planning instruments, works for the construction of new power lines or the replacement of existing ones with a power exceeding 30,000 volts are also subject to landscape authorisation.

Who it's for

Private and public entities requiring a landscape authorisation for the execution of infrastructure or construction works of a certain importance (quarries and mines, landfills, ski slopes, etc.).

What to do

The interested party (private or public body) submits a request to the Town Planning and Landscape Protection Service by certified electronic mail (PEC) to serv.urbanistica@pec.provincia.tn.it or via PiTre interoperability.

Within 60 days of the request, the CUP Sub-Commission gives a positive opinion on the planned interventions that it considers compatible with landscape protection. If the CUP Sub-Commission finds that the planned interventions are not compatible with landscape protection, it shall notify the applicant of the reasons for the refusal of authorisation before making a negative decision.

Within the deadline set by the CUP Sub-Commission, the interested party may propose alternative solutions consistent with the observations of the same commission. Once the deadline has expired to no avail, the Commission adopts the final decision of refusal. If alternative solutions are provided, the Commission makes a final decision on the new solutions.

Special cases

In order to enable the electronic communication of the outcome of the submitted applications, it is necessary for applicants to provide the office with an e-mail address (PEC, if available, or normal e-mail).

Designers are also requested to provide a normal e-mail address (alternative to PEC) for any informal contacts regarding the applications. Thank you for your cooperation.

  1. Application form for authorisation or opinion to the SubCUP;
  2. Technical and administrative documentation required for the type of authorisation requested, as specified in detail in the document "Table A - List of required documentation".

The application form includes the privacy policy provided for in Articles 13 and 14 of EU Regulation No. 679 of 2016, to be attached to the application duly signed for acknowledgement and knowledge.

ATTENTION: as many signed copies of the information notice as there are signatories (applicant, designer, etc. - each person signs only one copy) must be attached to the application.
