Application by the employer for the issue of a non-EU driver attestation for international transport purposes

Description

In order to carry out international carriage, it is necessary to hold a Community licence and, if the driver is a national of a third country (not a member of the European Union), also a driver attestation.

The driver attestation is issued by the competent authorities of the haulier's Member State of establishment, at the request of the holder of the Community licence, for each driver who is neither a national of a Member State nor a long-term resident within the meaning of Directive 2003/109/EC lawfully employed and put at the disposal of the haulier. It is issued by the Labour Inspectorate with territorial jurisdiction (in the Province of Trento by the Employment Service) in relation to the registered office of the employer or to the operational site where the driver concerned is permanently assigned or made available. In the case of temporary labour supply, the office responsible for issuing the attestation is identified in relation to the user company's operational headquarters.

The driver attestation shall be made out in the haulier's name and shall belong to the haulier, who puts it at the disposal of the driver named on the attestation when that driver drives a vehicle carrying out carriage by virtue of a Community licence issued to that haulier. It is drawn up in triplicate:

  • a certified true copy remains at the registered office of the undertaking or at the operational centre of the undertaking to which the driver to whom the attestation refers is permanently assigned. In the case of temporary work provision, the attestation remains at the operating centre of the user undertaking that requested it;
  • one copy is handed over by the employer to the driver named on the attestation;
  • a copy remains at the Labour Inspectorate (in PAT Servizio Lavoro) that issued the certificate.

The driver attestation must be presented at the request of control officers.

Restrictions

The employer is obliged to immediately return the two copies of the certificate in its possession:

  • in the event of the absence of even one of the conditions under which it was issued (e.g. termination of employment);
  • on expiry of the period of validity.

Who it's for

The application for the driver attestation must be submitted immediately upon the employment of the non-EU citizen and is valid for as long as the conditions under which it was issued subsist and in any case for a period not exceeding five years from the date of issue.

The haulier employer (Italian or foreigner legally residing in Italy) must request the issue of the driver attestation in order to employ the driver in international transport.

The application must be submitted on the appropriate form, enclosing the following documents.

  • a photocopy of an identity document of the declarant (if the declaration is signed with a handwritten signature and not in the presence of the employee in charge)
  • a €16.00 revenue stamp for each certificate requested;
  • valid Community licence for the international carriage of goods by road under Regulation (EEC) No 881/92;
  • driver's residence permit (if presented as a copy, the original must be presented within 30 days of issue of the certificate)
  • driver's passport (if presented as a copy, the original must be presented within 30 days of issue of the attestation)
  • driver's driving licence (if presented as a copy, the original must be produced within thirty days of issue of the certificate)
  • photocopy of the driver's tax identification number;
  • employment contract signed by the parties;
  • compulsory communication of employment to the competent Employment Centre  only if the communication was sent within the last 48 hours;
  • pay slip showing the last salary (only if the worker was already on the job);
  • last two DM 10 forms and payments (F24) of DM 10 submitted in the last two months;
  • in cases where the driver does not have a subordinate employment relationship, the applicant must provide any documentation proving that the driver is respectively a sole proprietor, company director, partner in the haulier's partnership, family member of the haulier, partner in participation in the haulier's company or worker member of the haulier's cooperative
  • in the case of the supply of temporary labour, the user company must also submit the relevant supply contract;
  • photocopy of the non-EU citizen's qualification card;
  • signed information notice from the driver.
