Extension of the effectiveness of environmental compatibility

This procedure concerns the extension of the effectiveness of the EIA measure in cases where the project realisation work cannot be completed within the time limit set by the same measure.

Who it's for

Subject, public or private, proposing the project.

The application may be submitted by the legal representative of the proposing entity or by his or her delegate (attaching a written power of attorney to the application).

What to do

The proponent submits the request for extension to the O.U. for Environmental Assessments, attaching the appropriate technical-environmental documentation in electronic format at least 120 days before the expiration of the effectiveness of the EIA measure.

The application form and the attached documentation must be transmitted preferably by certified e-mail to the following address valamb.appa@pec.provincia.tn.it.

Special cases

The extension of EIA measures issued prior to the entry into force of Provincial Law No. 6 of 2019 (Publication in the BUR No. 39 of 26-09-2019) is carried out in accordance with the provisions of Article 11 of the Decree of the President of the Province of 20 July 2015, No. 9-23/Leg and therefore the conclusion of the procedure is set at a maximum of 140 days from the submission of the application.

Documents to be submitted

  1. Application form for modification/extension of an EIA measure duly completed and under-signed;
  2. Extension report containing:
    - the rationale behind the extension request;
    - an analysis of the evolution of the environmental context and of the project, making a comparison between the predictions of the environmental impact study and the actual state actually found, in particular for the impacts and the planned mitigations, analysing the effectiveness of the latter and envisaging possible new mitigations to the work in order to reduce new or increased impacts, also in function of the monitoring carried out
    - the modalities of application of the environmental prescriptions/conditions and recommendations contained in the environmental compatibility measure;
    - the time required for the extension;
    - updating of the intervention in relation to planning and programming instruments;
  3. Updated project drawings, including any variants made, such as
    - current state planimetry, consisting of one or more graphical drawings, on an appropriate scale, intended to describe the actual state of the work, on the date of submission of the extension request
    - planimetry of comparison between the current state and the initial state, derived from the superimposition of the planimetry of the current state with the planimetry of the initial state of the site, before the beginning of the works, adequately highlighting the interventions already carried out
    - planimetry of comparison between the current state and the final state, with superimposition of the planimetry of the current state and the planimetry of the final state of the project subjected to EIA, in order to allow the identification of the works still to be carried out, described in the technical report
    - other graphic works considered significant, that may represent the works carried out, such as sections and elevations;
    - photographic documentation, consisting of some significant photographs of the current state of the work and the evolution of the interventions over time;
  4. Technical report, containing
    - technical description of the works carried out with particular reference to what was foreseen in the initial project and indicating which interventions are still to be carried out
    - description of any design variations adopted and the reasons for their application;
    - list of all authorisations acquired, including the building permit;
    - list of any authorisations still to be acquired.
  5. Monitoring report on environmental factors that collects and summarises, in a reasoned manner, the monitoring carried out on the various environmental factors, provided for in the environmental impact study, in the Environmental Monitoring Plan and/or prescribed by the environmental compatibility measure.

NBFor reasons related to the protection of personal data, it is necessary that the technical documentation to be published is without handwritten signatures. For this reason, it is preferable for all documentation to be digitally signed by the editors or for an unsigned copy to be provided (in addition to the signed copy) for publication, and for the Declaration of Correspondence of Documentation for Environmental Assessment Procedures (EIA) form to be completed.
