Consumer protection: inclusion in the list

A list of consumer and user associations is established at the Province. Registration is optional and allows you to benefit from certain provincial contributions.

Registration on the list of consumer and user associations is subject to the following requirements

1. presence of at least one operational branch on the provincial territory open to the public at least 10 hours a week
2. having been constituted, by public deed or authenticated private deed, for at least three years and possessing articles of association that enshrine a democratic-based organisation and provide for the protection of consumers and users on a non-profit-making basis as its exclusive purpose
3. maintenance of a list of members, updated annually, with an indication of the fees paid directly to the association for statutory purposes;
4. number of members not less than 0.2 per thousand of the provincial population;
5. performance of continuous activity in the province in the previous three years, with proof of having provided assistance and protection services to consumers and users in at least one hundred cases in the three-year period;
6. drawing up an annual income and expenditure budget;
7. not having its legal representative suffered any conviction that has become res judicata, in relation to the activity of the association itself, and not holding the title of entrepreneur or director of production and service companies in any form whatsoever constituted, for the same sectors in which the association operates
8. do not carry out, either now or in the future, any promotional or commercial advertising activities concerning goods or services produced by third parties, and do not derive either now or in the future, any economic advantage, even indirectly, from the activities of persons, entities or organisations that carry out, for any reason, commercial activities aimed at the production of goods or services, or carry out activities attributable to the liberal professions.

The interested party shall submit the application by one of the following means

1. by sending it by email to the PEC address indicated on the form;
2. by delivering it directly to the competent provincial structure, or to any other peripheral office of the Province
3. by sending it by registered mail A.R.

The following documents must be attached to the application

1. a simple copy of the articles of association and statutes of the association
2. a list containing the initials of the members, updated to the date of submission of the application, with an indication of the fees paid directly to the association for the statutory purposes
3. a report signed by the association's legal representative showing the composition of the association's governing bodies, its organisational structure (persons operating within the association in the province), as well as the requirements set out in Article 1(e) above
4. a copy of the final balance sheet for the year preceding the year in which the application is submitted;
5. signed copy of the information notice pursuant to Articles 13 and 14 of EU Regulation no. 679 of 2016;
6. copy of a valid identity document.

The application must be submitted during the period from 1 January to 30 June.

The association concerned shall be informed of the positive or negative outcome of the procedure.
