Description
Hydraulic fluvial areas (FIAs), together with ecological and landscape fluvial areas, are introduced by Part VI of the General Plan for the Use of Public Waters (PGUAP), governed by art. 32 of the Implementation Rules of the same Plan and reported in the Summary Hazard Map (CSP).
They represent the areas in which the possibility of expansion of the watercourses and therefore of flood overflow plays a prominent role and their identification (perimeter) is conducted in compliance with the general principles established by the PGUAP according to the criteria defined in paragraph 3.1 of the document "Technical provisions for the drafting of the Summary Hazard Map" approved with resolution no. 785 of 19 May 2017, and subsequently kept updated.
As provided for by paragraph 4 of art. 32 of the Implementation Rules of the PGUAP, the realisation of any intervention or artefact in river areas of hydraulic interest is allowed in compliance with the following conditions
- the overall storage capacity of the area is not appreciably reduced or hydraulic compensatory interventions are envisaged, subject to the specific consent of the competent hydraulic authority
- the hydrogeological risk conditions are not increased;
- the worsening of the hazardous conditions in the territories located downstream, even outside the provincial territory, is not determined;
- does not preclude the possibility of mitigating or eliminating the causes that determine the hazardous condition.
The cases of exclusion are governed by the Resolution of the Provincial Council no. 1387 of 30 May 2008 as amended.
