Application for advance payment of child maintenance allowance

The Autonomous Province of Trento, through the Agenzia per l'assistenza e la previdenza integrativa (Agency for Supplementary Assistance and Welfare), provides the custodial parent with advance maintenance allowance for the child, if it is not paid by the obligated parent under the terms and conditions established by the judicial authority

The benefit consists in the granting of a monthly allowance, of annual duration, in favour of the custodial parent of the child forming part of the foster parent's household. The benefit may be renewed, until the child comes of age, upon presentation of self-certification on the continuation of the requirements.

The monthly amount of the allowance is determined, taking into account the number of minor children concerned by the payment of the maintenance allowance, as an amount not exceeding the sum established in the judicial decree, within a maximum amount revalued annually by resolution of the Provincial Council.

For the period 01.09.2024 - 31.08.2025, the maximum amount of the monthly maintenance allowance is €376.44 per minor child.

For access to the benefit, the foster parent must meet the following requirements on the date of application

• registered residence in the territory of the Province of Trento
• belonging to the same household as the minor
• family economic condition indicator (ICEF) lower than 0.19

The following conditions must also be met

• the existence of a court order, having the value of an enforcement order, establishing the amount and the modalities of the obligatory parent's contribution to maintenance
• the existence of a writ of summons duly served and not complied with within ten days or of a judgment declaring the bankruptcy of the companies, established in a form other than a corporation, of which the obligor is the owner
• the minor age of the child
• the declaration of subrogation issued by the applicant, transferring to the Autonomous Province of Trento the right to claim against the parent obliged to maintenance
• that both parents have been resident in the Province of Trento and that the judge's ruling on the child support payment is subsequent to the date of acquisition of such residence.

The application for the advance payment of maintenance allowance must be submitted to the Provincial Agency for Supplementary Assistance and Welfare, also through the provincial branch offices.

1. Application form duly completed and signed by the applicant.
2. Copy of the court order, having the force of an enforcement order, establishing the amount and the modalities of contribution by the obligated parent.
3. Copy of the writ of execution duly served on the obligor and not complied with within ten days.
4. Deed of subrogation in favour of the Autonomous Province of Trento at the creditor's will pursuant to Article 1201 of the Civil Code, with notification to the debtor party by registered mail with return receipt.
