Description
The amount of energy owed by concessionaires for 2009, calculated by PAT's Public Water Utilisation Service on the basis of existing hydroelectric concessions, is about 160 GWh.
In addition, pursuant to Article 8 of Presidential Decree No. 235/77, the consortia of municipalities provided for by Law No. 959 of 27 December 1953 (BIM consortia), can cede to the Province of Trento the right to the supply of electrical energy pursuant to Article 3 of the aforementioned law against payment of a fee equivalent to the surcharge established by Article 1 of the aforementioned law No. 959. The Province disposes of the energy thus acquired pursuant to Article 13 of Presidential Decree No. 670/72. On this specific point, negotiations are underway between the Province and the BIMs themselves in order to realise the maximum valorisation of the energy available, without jeopardising the economic benefits guaranteed to the hydroelectric exploitation areas by the aforementioned legislation.
Article 39 of Provincial Law no. 3 of 16 June 2006, instituting the Provincial Energy Agency (APE), assigns to APE itself - and in particular to the Energy Management and Authorisation Service - the management of the energy in question, while Provincial Law no. 4 of 6 March 1998, in Article 21, provides for the public services and the categories of users to which the energy may be allocated.
In implementation of the aforementioned legislation, the Provincial Energy Agency submits annually to the Provincial Council for approval a Plan for the transfer of the energy available to the Province itself to a set of public users, both provincial and municipal, aiming at the direct and total exploitation of this resource. If the energy is not totally used to satisfy utilities, it is monetised in the manner established by the aforementioned Article 13 of the Statute of Autonomy.
