Water concessions - Notification of surrender or termination

The notice of waiver is submitted in the event that all the holders (in the case of deceased holders, all the heirs of the deceased holder) of current (i.e. not already expired) public water derivation utilities wish to communicate the waiver of the water derivation title in its entirety (i.e. with the divestment, in the timeframe and manner described below, of all the works through which the derivation is exercised).

The same communication must also be submitted in all cases of termination of the title for reasons other than the renunciation of the holder (for example, in the case of derivation titles that have already expired, the holder/heirs of the holder being obliged to carry out the divestment of all the works through which the derivation is exercised).

In cases where:

- only some holders/heirs of holders wish to communicate the divestment;

- only some holders/heirs wish to communicate the divestment of only some of the works through which the derivation is exercised;

i.e. in the event that at least one intake work remains active serving even only part of the area served by the user, the relevant variant form must be submitted, depending on the case, (since such communications involve a change to the user - subjective or objective - and since in such cases the user remains active).

Water concession holders no longer interested in maintaining their concession

Applications may be submitted by Citizens, Companies, Individuals, Professionals, Bodies and other Organisations

The communication must be submitted to the Water and Energy Resources Management Service, also through the territorial assistance and information desks, in one of the following ways

- sent by ordinary mail/recorded delivery to the following address: Water and Energy Resources Management Service, Piazza Fiera 3, 38122 TRENTO;

- sent by e-mail (e-mail or PEC; PEC is mandatory only for enterprises/companies and freelancers required to be registered in the INI-PEC) to the following address: serv.acquenergia@pec.provincia.tn.it.

• form RRCOMND (certifying with a declaration in lieu of affidavit, as appropriate, that the user's works have been rendered unusable and/or that the works have been removed/demolished/secured, or that they do not exist), for cases of relinquishment of the water derivation concession concerning

- derivations of groundwater or water from a spring that do not insist on state-owned land or within the buffer strips of state-owned watercourses (10 m)

- derivations from non state-owned watercourses (not falling within the provincial water demesne)

- derivations from any body of water, even on state-owned property or land or in the buffer strips of state-owned water courses (10 m from the same), carried out by means of mobile works

- water derivations for which the works are found to no longer exist;

• RRCOM form, for the remaining cases of relinquishment of the concession (this is a "preliminary" relinquishment to which the documentation described therein must be attached, including photographic documentation, certifying the state of affairs of the user). The RRCOM form must be followed, once the works have been carried out with any prescriptions dictated by the Servizio Bacini Montani or authorised by the Servizio Gestione Risorse Idriche ed Energetiche (Water and Energy Resources Management Service), by the DMS form certifying that all the works have been abandoned.

These forms must be supplemented with the following annexes, contained in the forms and in the relevant instructions for completion:

• proxy to one of the joint holders, in the event that the concession is in the name of several holders and/or there are heirs of deceased holders;
• substitute declaration of the heirs issued by the Municipal Offices, in the event that there are deceased holders;
• metal plaque identifying the outlet (5 x 10 cm in size, on which the utility identification number is stamped, e.g: C/10933, R/1256), if in the holder's possession (otherwise: declare its loss/stolen at the bottom of the forms)
• photocopy or scan of an identification document of each subscriber (always);
