Updating land registry data (Pregeo)

Holders of rights in rem over real estate that have undergone

• changes in the configuration and surface area of plots of land
• changes following the erection, alteration or demolition of buildings

are required to communicate these changes by means of a cadastral update deed, called Type of fractionation, prepared with PreGeo software (more details at https://www.provincia.tn.it/News/Pregeo) by a qualified technician.

Fees are due for each application for approval, which may be repeated a second time without payment of further fees, within 60 days of the notice of non-registrability.

The request for updating can be submitted by property owners.

The variation is prepared by a qualified technician registered with the Professional Orders and Colleges (architect, engineer, agronomist and forestry doctor, surveyor, building surveyor, agronomist and agrotechnician) who is in charge of preparing the updating act.

The appointed technician must prepare a request for updating cadastral data and submit it exclusively electronically through the OPENkat portal as provided for by the Resolution of the Provincial Council no. 339 dated 13 March 2020 and the consequent Determination of the Land Registry Service Manager no. 3 dated 27 March 2020.

A declaration drafted by a qualified professional technician, prepared with the Pregeo programme and signed by the professional by means of a digital signature, must be submitted.

Requests for updating must contain

• model F, which constitutes the type of fractionation and contains the schedule of general data, the schedule of the division, the movement of the surfaces, the map extract with the insertion of the variations, the outline of the survey, the booklet of measurements
• the technical report;
• a copy of the drawings in digital format.

If new fiduciary points are established, the relevant monographs must be submitted.

The outcome of the request is visible on the OPENkat portal to the technician who submitted the cadastral update document:

• in case of a positive outcome, the file is returned with the approval signature of the director of the competent cadastral office. The returned documentation is valid for 2 years from the date of approval.
  The type of fractioning is validated in the deeds following the submission of a land registry request, attaching the necessary documentation (please refer to the Land Registry Land Registry Request service)
• if the outcome is negative, the reason for rejection will be communicated.
