Updating building cadastre data (Docfa)

The construction of new buildings and changes in the status of existing buildings must be declared in the land register.

Owners of rights in rem over buildings that have undergone a change as a result of erection, alteration (reconstruction ex novo, extensions, merger, fractioning, change of use, new distribution of internal spaces, changes in material portions, etc.) or demolition, are required to submit an application for cadastral updating prepared with DOCFA software ( details at https://www.provincia.tn.it/News/Docfa ) by a qualified technician.

The following are excluded from the registration obligation

• isolated buildings with a covered surface area of less than 8 square metres, only if they do not constitute accessories serving ordinary property units;
• greenhouses used for the cultivation and protection of plants on natural soil without permanent cover
• aquaculture tanks or storage tanks for irrigation of land, only if they do not constitute accessories serving ordinary building units;
• isolated artefacts without a roof;
• canopies, pigsties, henhouses, manure sheds, wells and the like, with a useful height of less than 1.80 metres, provided they have a volume of less than 150 cubic metres, only if they do not constitute accessories serving ordinary building units
• precarious artefacts, without a foundation, not permanently fixed to the ground;

The category of the building unit is assigned on the basis of the general framework of categories.

The deadline for submission is set at 30 days from the date of usufruct as a result of works, opening of succession at the Inland Revenue Agency, in the case of death or taking possession of a property as a result of deeds.

Fees calculated for each property unit are due for each declaration, which may be repeated a second time without payment of further fees, within 60 days of the notice of non-registrability.

In the event of late submission, penalties shall be applied in accordance with the regulations in force.

The request for updating may be submitted by at least one of the owners of the rights in rem over the property.

The change is prepared by a qualified technician registered with the Professional Orders and Colleges (architect, engineer, agronomist and forestry doctor, surveyor, building surveyor, agrarian surveyor limited to rural buildings, and agrotechnician).

The appointed technician, once the updating document has been prepared, by means of the Docfa software (downloadable free of charge) must compulsorily send it electronically through the OPENKat portal as provided for by the Resolution of the Provincial Council no. 339 dated 13 March 2020 and the consequent Determination of the Land Registry Service Manager no. 3 dated 27 March 2020.

The document prepared through the Docfa programme is ordinarily composed of the following models

• model 1N (I and II part) for the declaration of units belonging to cadastral categories A - B - C
• model D1;
• model 2N (I and II part) for the declaration of units belonging to cadastral categories D - E with the obligation to declare the estimated elements;
• planimetric elaboration (compulsory in the presence of a building with at least two units);
• floor plans.

Generic supplementary attachments such as material division plans, photographic documentation or special forms can be added to the declaration/notification.

The deadline for the procedure is set at

• 90 days from the date of submission for categories A - B - C (date referred to the transmission through the OPENkat portal of a document that has passed formal checks and is in "checked" status)
• 180 days from the date of submission for categories D - E (date referred to the transmission through the OPENkat portal of a document that has passed formal checks and is in "checked" status)

If the outcome is positive, the file is returned with the approval signature of the director of the competent land registry office.
