Description
The construction of new buildings and changes in the status of existing buildings must be declared in the land register.
Owners of rights in rem over buildings that have undergone a change as a result of erection, alteration (reconstruction ex novo, extensions, merger, fractioning, change of use, new distribution of internal spaces, changes in material portions, etc.) or demolition, are required to submit an application for cadastral updating prepared with DOCFA software ( details at https://www.provincia.tn.it/News/Docfa ) by a qualified technician.
The following are excluded from the registration obligation
- isolated buildings with a covered surface area of less than 8 square metres, only if they do not constitute accessories serving ordinary property units;
- greenhouses used for the cultivation and protection of plants on natural soil without permanent cover
- aquaculture tanks or storage tanks for irrigation of land, only if they do not constitute accessories serving ordinary building units;
- isolated artefacts without a roof;
- canopies, pigsties, henhouses, manure sheds, wells and the like, with a useful height of less than 1.80 metres, provided they have a volume of less than 150 cubic metres, only if they do not constitute accessories serving ordinary building units
- precarious artefacts, without a foundation, not permanently fixed to the ground;
The category of the building unit is assigned on the basis of the general framework of categories.
Restrictions
The deadline for submission is set at 30 days from the date of usufruct as a result of works, opening of succession at the Inland Revenue Agency, in the case of death or taking possession of a property as a result of deeds.
Fees calculated for each property unit are due for each declaration, which may be repeated a second time without payment of further fees, within 60 days of the notice of non-registrability.
In the event of late submission, penalties shall be applied in accordance with the regulations in force.
