Description
This is a contribution through which businesswomen, self-employed women and freelance professionals (hereinafter also referred to as 'recipients') can be temporarily replaced in their work by a person, for reasons related to pregnancy, maternity and child-rearing. Replacement may take place for a maximum of 18 months, even if not continuous. The project may be extended or renewed, subject to a maximum duration of 18 months.
Agenzia del Lavoro grants a contribution of up to EUR 25,000.00 to cover part of the costs of the temporary replacement. The employment relationship established between the addressee and the substitute may be of an employed or, alternatively, self-employed nature, in compliance with the relevant regulations in force. In the case of a replacement with an assignment of a self-employed nature, the assignment must be in writing under penalty of forfeiture.
In the case of a businesswoman, partner in a company, or participant in a family business, the replacement takes place exclusively by means of employment under a contract of employment.
The project may provide for a partial replacement covering only part of the recipient's activities or a total replacement of the recipient. In any case, the relationship established must be compatible with the type of activities to be performed and with the professional characteristics of the replacement. As from the child's third birthday, the replacement may only be partial and may not exceed 30 hours per week.
In the event that the project envisages a total substitution, it is forbidden for the recipient to be present at the place(s) of work where the activity for which the substitution has been requested is carried out during the hours 10 a.m. - 12 noon and 3 p.m. - 5 p.m. The prohibition of coexistence between substitute and incumbent does not apply in the first month of substitution.
In the event that the project provides for a partial substitution, the beneficiary may be present at the place/places of work where the activity for which the substitution has been requested is carried out, exclusively in the morning time slot 10.00-12.00 or, alternatively and at the applicant's choice, in the afternoon time slot 15.00-17.00. This choice shall be made explicit in the grant application. Any changes must be communicated in advance in writing to Agenzia del Lavoro.
No more than one project can be activated at the same time.
The contribution is granted only if the national call for applications provided for by Article 9 paragraph 3 of Law no. 53/2000 has not been activated and is granted on a de minimis basis.
Restrictions
Recipient requirements
- Female entrepreneurs with registered office or place of business in the province of Trento, with less than 10 employees;
- Self-employed women working in the province of Trento, with less than 10 employees;
- female members of companies with registered office or place of business in the Province of Trento, with less than 10 employees, with the exclusion of female members of companies wholly or predominantly owned by the State and their subsidiaries;
- family members participating in the business enterprise referred to in Article 230 bis of the Civil Code with registered office or place of business in the Province of Trento (in this case, substitution cannot take place with participants in the family business referred to in Article 230 bis of the Civil Code or with associates in participation referred to in Articles 2549 et seq. of the Civil Code)
- coordinated and continuous collaborators operating in the province of Trento.
In addition, they must have been enrolled for at least six months in a compulsory insurance scheme for social security and welfare purposes and have regular contributions.
To apply for the contribution, the recipient must be in one of these two situations
- be pregnant
- have reconciling needs of the recipient in relation to children in their first 12 years of life and living together
Requirements of the substitute
The person identified by the addressee must meet at least one of the following requirements
- be enrolled in the professional association or college required to carry out the activity
- have the formal qualification entitling him/her to carry out the activity;
- have experience deriving from at least two years of continuous work in a self-employed or subordinate capacity in activities related or similar to the replacement, excluding periods of apprenticeship or be registered in the Co-Manager's Register.
To identify the replacement, the applicant may indicate a person of his/her choice, or contact the local Job Centre.
