Road passenger transport - Certificate of professional competence

Pursuit of the occupation of road passenger transport operator is the business activity exercised by transferring persons, for remuneration, by means of buses i.e. motor vehicles designed to carry more than nine persons, including the driver.
Buses for own use within the meaning of the first paragraph of Article 83 of the Road Traffic Act are excluded.

Exercise of the profession requires the mandatory passing of an examination that permits the attainment of a certificate of professional capacity for the activity of passenger transport operator.

The examination consists of two written tests of two hours each consisting respectively of

1. a questionnaire consisting of sixty questions to be answered from a choice of four alternatives; a maximum of sixty points are awarded for the assessment of the test
2. an exercise on a practical case; a maximum of forty points shall be awarded for the evaluation of the test.

The examination is passed if the candidate obtains

• at least thirty points for the questionnaire test mentioned under 1;
• at least sixteen points for the exercise test referred to under 2;
• and an overall mark, resulting from the sum of the marks for both tests, of at least sixty points (60/100).

Examination preparation courses
Courses for preparing for the examination are entrusted to training bodies accredited by the Ministry of Transport.
In Trentino the accredited bodies are the following
- the Professional Training Centre of the Trentino People's University
- theRendena driving school.

Subjective requirements:

• legal age;
• not judicially disqualified or incapacitated;
• have completed compulsory schooling and passed a secondary school course or, alternatively, attended a specific preliminary training course at duly authorised bodies.

Professional competence is required of the transport manager, i.e. the person who also possesses the requisite of good repute and who continuously and effectively manages the transport activity.
The transport manager may only manage the transport activity of one company and must hold one of the following positions within the haulage company, alternatively

1. sole director, i.e. member of the board of directors, for public legal persons, for private legal persons and, subject to number 2), for any other type of entity
2. unlimited partner for partnerships;
3. owner of the sole proprietorship or family business or collaborator in the family business;
4. person, bound by an employment relationship, to whom the relevant powers have been expressly conferred.

Alternatively, the company, with a total fleet of up to fifty vehicles, may designate, by means of a written contract, an external transport manager, who may not be linked to any other road transport company.
