Authorisation of retirement during a part-time employment relationship

Description

In order to encourage the hiring of new staff, workers who meet the age and contribution requirements for access to retirement, as per Table B annexed to Law No. 335 of August 8, 1995, and are employed by companies, may be granted the right to a retirement pension and the right to change to part-time employment not less than 18 hours per week.
The faculty referred to in this paragraph is granted, with the prior authorisation of the provincial labour and maximum employment office, without prejudice to the starting dates of the treatments provided for by the law in force, on condition that the employer hires new staff for a duration and a working time not less than that reduced to the workers availing themselves of the aforesaid faculty.
For the latter, the amount of the pension is reduced in inverse proportion to the reduction in normal working hours, which reduction may not exceed 50 per cent. The sum of the pension and the salary may in no case exceed the amount of the salary due to the worker who, other things being equal, works full-time.
