Producers and/or users of excavated material are obliged to send communications concerning the management of such material

Description

The term excavated soil and rocks refers to the excavated soil resulting from activities aimed at the construction of a work.

The producer of excavated soil and rocks must send a declaration concerning the characteristics of the materials to be excavated, at least 15 days before the start of excavation activities.

Restrictions

Failure to notify use within the notified time limit results in the termination, with immediate effect, of the qualification of excavated earth and rocks as by-products. They are then subject to the waste legislation, with the relevant criminal and administrative consequences.

Who it's for

The declaration must be signed by the producer, i.e. 'the person whose material activity produces the excavated earth and rocks', i.e. generally the legal representative of the company carrying out the excavation.

What to do

The notice of use and the declaration of use must be submitted by sending the relevant form to the certified mailbox suolo.appa@pec.provincia.tn.it.

Timeframes and deadlines

You will receive, at the email address used for sending the form, confirmation of receipt of the communication with the relevant protocol number.

After use and within the validity period indicated in the declaration of use, you must send the declaration of use.

Stamp duty not due, according to current legislation.
