Procedure for granting or refusing the grant
The procedure for granting or refusing the grant is divided as follows:
1. notification of the commencement of the administrative procedure and provision of the information required under Provincial Law 23/1992, as amended;
2. verification of the documentary eligibility of all applications submitted and the drawing up of the list of beneficiaries (ranking list), taking into account the priorities and scoring criteria set out in this call for applications.
Applications that do not meet the eligibility criteria for applicants or that do not achieve the minimum required score shall be deemed ineligible;
3. approval, by decision of the Head of the Forestry Service, of a merit-based ranking of applications within 90 days from the closing date for the submission of such applications, marking the conclusion of the first phase of the administrative procedure pursuant to Provincial Law 23/1992, as amended and supplemented. The decision shall contain a list of all applications submitted, divided into eligible applications with their respective scores (ranking list) and ineligible applications.
Eligible applications will be categorised as follows:
a. eligible applications potentially eligible for funding on the basis of the allocation provided for in point 8;
b. eligible applications on the reserve list (a list intended to make up for any reductions in expenditure determined during the subsequent technical assessment phase, drawn from the ranking list up to a maximum of 20 per cent of the aforementioned allocation);
c. eligible applications not to be subject to technical assessment.
The ranking list shall remain valid for no more than 12 months from the date of its approval.
4. notification to the applicant of their application’s position on the list approved by the decision referred to in the previous point. This notification also serves to inform the applicant of the immediate commencement of the technical assessment or of the application being placed on hold pending a possible subsequent review;
5. Adoption of the grant decision, subject to the completion of the technical assessment aimed at drawing up the ‘Technical and Administrative Verification Report’ by the designated technical officer, with a view to defining the amount and type of eligible expenditure and the corresponding grant;
The assessment and subsequent grant are processed strictly in accordance with the order of the merit list, in accordance with the following procedures:
6. for applications covered by the initial allocation set out in Chapter 8, the grant decision shall be adopted within 90 days from the day following the date of adoption of the resolution approving the merit ranking list;
7. should additional financial resources become available during the ranking list’s period of validity (arising from withdrawals, savings on expenditure or increases in the allocation authorised by the Provincial Executive), the Forestry Service shall proceed to move down the ranking list, initiating the technical assessment for the subsequent eligible applications. In such cases, the 90-day period for the adoption of the grant decision shall run from the date of the administrative act confirming the actual availability of funds in the relevant budget headings.
The grant decision may impose conditions that must be fulfilled prior to payment. The amount awarded may not, under any circumstances, exceed the theoretical maximum resulting from the application of the eligibility ranking criteria. Decisions to award grants may be made cumulatively, even in several instalments, taking into account the progression of the ranking list. Applications deemed eligible but not funded due to the exhaustion of financial resources shall be deemed rejected upon expiry of the ranking list’s validity period, without the need to issue individual rejection notices.
8. Notification to the applicant of the grant’s approval or rejection;
9. submission and management of any applications for changes during construction and/or extensions.
