Deposit the conciliation report signed at the trade union with the Employment Service

Description

In private and public labour disputes, if an agreement is reached outside the Employment Service and the worker is assisted by a trade union organisation, it is possible to deposit the conciliation minutes signed with the assistance of a trade unionist with the same Service pursuant to Article 411 of the Code of Civil Procedure.

This provision is addressed to all persons who are parties to a labour dispute and who have signed a conciliation report at the trade union.

What to do

This requires at least two original copies signed by at least the employer, the employee and the employee's trade unionist. The parties to the dispute must delegate one of them, or even an external party, to file the conciliation statement with the Labour Service, pursuant to Article 411 of the Code of Civil Procedure. The delegate presents himself at the aforementioned Service and, before an official, signs the declaration of deposit of the conciliation report. Once it has been filed, the Employment Service will in turn file it with the clerk of the Employment Court.
