Authorisation of egg packing centres

Commission Delegated Regulation (EU) 2465/2023 of 17 August 2023 supplements Regulation (EU) No. 1308/2013 by laying down the marketing standards applicable to eggs and repealing the previous Regulation (EC) No. 589/2008.

Among the main provisions, it defines the criteria for grading Class A eggs by weight:

XL - very large: weight of 73 g or more.
L - large: weight equal to or greater than 63 g and less than 73 g.
M - medium: weight of 53 g or more and less than 63 g.
S - small: weight less than 53 g.

CommissionImplementing Regulation (EU) 2023/2466 of 17 August 2023 lays down detailed rules on the marketing standards applicable to eggs.

The main provisions concern:

Packing Centres: Only authorised packing centres may carry out the grading, packing, repacking and labelling of eggs.

Record Keeping: Requires producers, egg collectors and packing centres to keep specific additional records to allow checks on compliance.

Compliance Checks: Defines the parameters for the checks that Member States must carry out to ensure that eggs meet the marketing standards.

Both regulations were published in the Official Journal of the European Union on 8 November 2023 and entered into force on the 20th day after publication.

The main addressees of Regulations (EU) 2023/2465 and (EU) 2023/2466, as indicated in the attached application form and in the context of the discussion, are companies (firms or operators) wishing to obtain authorisation to engage in the activity of grading and packing eggs (so-called 'egg packing centres').

1. The attached form must be completed:

"APPLICATION FOR AUTHORISATION FOR EGGS PACKING CENTRE" in each section, providing the following information:

Applicant's data: Surname, first name, tax code and qualification (interested party, delegate, legal representative of legal entity).
Addresses: Physical domicile/registered office, PEC address (mandatory for companies/corporations) and ordinary email address.
Declarations of Law: Declaration pursuant to Articles 46 and 47 of Presidential Decree 445/2000 on the truthfulness of the information.
Head Office of the Packaging Centre: Address and location.
Title of Possession: Specify the title of possession of the property (ownership, rental, loan for use, other).
Conformity and Approval: Declare that the centre complies with EC Regulation No 853/2004 and indicate the details of the approval decree issued by the ASL (Local Health Authority) (number and date).
Plant and Equipment: Technical details on grading machines, sorting machines, candling equipment, packaging equipment, storage equipment and approved scales.
Business Organisation and Sourcing: Type of business, number of workers, sources of egg supply (own farms/under control/others) and collection areas/selling markets.
Destination of Eggs: State whether you intend to process eggs intended for the food industry, non-food industry and/or final consumer and whether you intend to grade eggs EXTRA FRESH.

2. Stamp duty

There is a section in the form for declaring compliance with stamp duty, specifying whether you are exempt (and the reason for this) or whether payment was made by means of a stamped or electronic mark (with details).

3. Necessary Attachments

Photocopy of the applicant's identity document (necessary if the application is signed with a handwritten signature and sent via postal service or e-mail, or if not in the presence of the employee in charge).
Proxy form, if any, if the application is submitted by a proxy.

4. Signing and Sending
The application must be signed and dated in the "SIGNATURE" field.

Article 4 paragraph 7 of Ministerial Decree 2009 states that the Regions and Autonomous Provinces are obliged to check

• at any time
• and in any case at least every three years

that the packaging centres maintain the requirements necessary for their authorisation.
