Authorisation for children and adolescents to take part in chequered shift work and authorisation for children and adolescents to take reduced intermediate rest periods in the absence of collective agreement provisions

Description

The work of children and adolescents, employed by employers, is governed by the provisions of Law L. 17 October 1967, No 977. Children' means minors who have not yet reached the age of 15 and are still subject to compulsory schooling. Adolescents' are children between the ages of 15 and 18 who are no longer subject to compulsory schooling.

Children and adolescents may not be assigned to work under the chess shift system; where this system of work is permitted by collective labour agreements, the participation of children and adolescents may be authorised by the Provincial Labour Inspectorate.

The working time of children and adolescents may not last more than four and a half hours without interruption. If the daily working time exceeds four and a half hours, it must be interrupted by an intermediate rest of at least one hour. Collective agreements may reduce the duration of the rest to half an hour. The reduction referred to in the preceding paragraph, in the absence of provisions in collective agreements, may be authorised by the Provincial Labour Inspectorate, after consulting the competent trade unions, when the work is not dangerous or burdensome.
The Provincial Labour Inspectorate may prohibit children and adolescents from remaining on the work premises during their breaks.
