Authorisation for the transboundary transport of waste

The reference legislation is EC Regulation 1013/2006 (hereinafter Regulation) and Article 194 of Legislative Decree 152/2006. The procedure concerns obtaining authorisation for the export (or import) to the European Union or to third countries of waste that is not on the "green list" under theRegulation.

If the waste falls under the "green list" pursuant to Art. 18 of theRegulation, no authorisation must be applied for, but the transport is carried out directly using Annex VII of theRegulation.

The consent is issued to the notifier (the person responsible for the shipment) by the competent authorities of dispatch, destination and transit (if any).

In the Province of Trento, the competent authority of dispatch (or import) is the Provincial Agency for Environmental Protection - Integrated Environmental Authorisation Organisation Unit.

The Notifier must submit the complete application dossier with a revenue stamp and make the payment of €129.11.

After authorisation has been obtained, the issue of the "Movement Document for Movements" is subject to payment of €25.82 for each form applied for and the financial guarantee.

- Producers of waste not on the "green list";

- Notifiers within the meaning of Art. 2(15) of the Regulation;

- Waste recovery or disposal facilities.

The legal representative of the company acting as Notifier may submit the application.

In brief:

1. the Notifier sends the request, on its own letterhead, to the competent authority of dispatch, to the pec address aia.appa@pec.provicia.tn.it., for the issue of the "Notification Document for Movements" and the "Movement Document for Movements";
2. the competent authority transmits the documents referred to in point 1) requesting the necessary documentation (see file "Transboundary transport of waste - documentation required for submission of the notification dossier" in the "Forms" section);
3. The notifier sends the "notification dossier" consisting of the documentation requested in point 2) to the pec address aia.appa@pec.provicia.tn.it;
4. the competent authority of dispatch verifies that the dossier is complete (or requests any additions) and transmits it to the other competent authorities
5. the competent authority of destination sends the "acknowledgement of receipt" to the notifier and to the other competent authorities, pursuant to Article 8(2) of the Regulation;
6. within 30 days from the date of the "acknowledgement of receipt" all the competent authorities must issue their own permit in accordance with Art. 9 of the Regulation; the permit issued is valid for a maximum of 1 year (maximum 3 years only if the destination facilities are pre-consented recovery facilities, in accordance with Art. 14 of the Regulation)

The Notifier shall apply to the competent authority of dispatch for the issue of the "Movement Document for Movements" (International Transport Forms) by submitting the financial guarantees in accordance with the terms and amounts laid down in Article 6 of the Regulation and Ministerial Decree 370/1998.
