Description
The Code of Cultural Heritage and Landscape (Legislative Decree No. 42 of 22 January 2004, Art. 106, Paragraph 2bis) provides that public territorial entities that intend to grant a concession to third parties for a cultural asset they are entrusted with must first acquire the authorisation of the protection body.
The authorisation is granted only on condition that the concession guarantees the conservation of the good and its public enjoyment, and that the intended use is compatible with the historical and artistic character of the good. In the authorisation, the conservation body may lay down prescriptions for the best conservation of the property.
